The first issue is related to the Corner Bakery. The PDP showed the Corner Bakery replaced with new College Avenue shops that conformed to the Land Use Code. Due to unsuccessful negotiations with Corner Bakery, the FDP shows the bakery remaining in.place. Planning has indicated that such a configuration is not in conformance with Code and they feel the plan will need to go back to Planning as they cannot approve the FDP as proposed. Bryan McFarland has indicated they are not able to go back to Corner Bakery at this time because they cannot keep absorbing these additional costs as a result of the City not willing to utilize eminent domain. He is asking that we try to figure out a way that they can move forward with the proposed plan. He is confident that Corner bakery will eventually be purchased and redeveloped, but it can't happen now. The second issue is related to overall square footage proposed. The FDP has reduced the overall proposed square footage of the project by roughly 16%. The Redevelopment Agreement defined the project.as having approximately 735K square feet. The proposed square footage is 620K. Bryan has indicated this is all market driven and we will have to work through it. This obviously has ramifications on all our projections. Bryan indicated that both these issue will be addressed in their comments on the Redevelopment Agreement.
