10/21/2013: If the Planning Area 1 plans need to be filed before the Foothills Mall Redevelopment
Subdivision Plat is recorded, an alternative might be filing a Minor Amendment. By changing the legal
description to reflect the existing Subdivision Plats already recorded, the Planning Area 1 plans could
be filed as a Minor Amendment to the existing plans on file.

10/22/2013: Will the Larimer Canal be relocated prior to Phase One construction?
As per the submittal, the area of wetlands impacted by the relocation of the Larimer Canal No. 2 is
0.196 acres. However, as I understand it, the wetlands will not all be mitigated at the same time, e.g., a
portion will be impacted through the excavation permit and a portion will be impacted at the time of
Phase One as well as the time of the Major Amendment. Can an updated ECS be provided that
stipulates when the impacts will occur how these impacts will be mitigated for? Is there an Army Corps
of Engineers permit already, and if so, can that also be provided?
I have spoken with the Natural Areas Department and they are available to still conduct the off -site
mitigation, if that is still your request. Please let me know.

Provide a tree survey and mitigation plan for the project. Include a sheet showing all the existing trees
shown and numbered. This information is available on Sheet Number C405 of the Existing Tree Plan
Southwest. Include a table on that sheet listing all existing trees by number, species, size, condition
and with the mitigation number. This information is available in the Tree Survey November 2012.
Provide the required number of upsized mitigation trees on site and/or offsite. Upsized Trees should
be sized as follows:
Shade Trees 3.0 inch caliper
Ornamental Trees 2.5 inch caliper
Evergreen Trees 8 feet height

Provide a statement explaining why existing significant trees cannot be retained or transplanted. The
statement should address the LUC requirement to retain existing trees to the extent reasonably
feasible.
"Extent reasonably feasible shall mean that, under the circumstances, reasonable efforts have been
undertaken to comply with the regulation, that the cost of compliance clearly outweigh the potential
benefits to the public or would unreasonably burden the proposed project, and reasonable steps have
been undertaken to minimize any potential harm or adverse impacts resulting from noncompliance

10/15/2013: The decorative pedestrian street lighting proposed along College Avenue in front of the
Phase One building will need to be modified.
The City�s recently adopted Midtown Plan calls for this type of lighting to follow the standard light
fixture currently used at the Harmony Road and College Avenue intersection in Fort Collins. The
Midtown Plan goes on to state that these lights will be used mid -block along College Avenue, and that
they should be evenly spaced.
This lighting can be found online at Architectural Area Lighting, http://www.aal.neY The fixture should
be the bronze color and be the full cut-off, as shown in the photos.
It appears that the pedestrian lighting may be located in the right-of-way. We do not have a plat yet, so
we can't confirm. If the place -making decorative lighting will be located in the R.O.W, the City of Fort
Collins Engineering Department will require an encroachment permit or the lighting will need to be
relocated out of the right-of-way.
The excerpt from the Midtown Plan and photo examples were sent on October 15 to X Design Group,
SEM Architecture and Alberta. This will need to be updated on the plans by the end of October.

10/22/2013: Phase One exhibit references the Block 16 of the larger plat (that I understand to be)
approved with Phase Two. This does not make sense. City Staff suggests a separate final plat for
Phase One to be approved the same time as the Phase One Final Plans, and then the larger plat can
be a replat of the phase one plat.

especially in high visibility areas (such as along College Ave and the north elevation). The lanscape
plan is required to incorporate additional trees in front of the building.
