The City had recently received calls from homeowners in the _Rain C g own homes with concerns
about the landscaping at the project. To address their concerns, I met homeowner representatives
and walked the project comparing what has been installed with the approved City plan. Since many
changes had been made from the approved plan, an attempt was made to use equivalency to determine
deficiencies.
The enclosed red -lined copy identifies the changes and additions that need to be made to make
this plan equivalent to what was approved and acceptable by the City. If you disagree with any
of these requirements, you should put them in writing and mark them on a plan for our review,
and submit the change request to the Planning Department through the administrative change
process. Any requested administrative change should be reviewed and endorsed by the homeowner's
association.
The City has on file a letter of credit for the completion of the landscaping. The letter
expires January 7, 1996. In order to avoid having the City collect on the letter, an amended
letter of credit should be submitted to the Zoning Department, with a new expiration date of May
30, 1996.
Please be advised that failure to comply with the approved plan to complete the landscaping by
May 30, 1996 will be considered to be a violation of Section 29-526 (L) (1) of the City Code,
and could result in a fine of $1,000 per day of violation.
In the future, you should follow the approved plan or obtain an administrative change.
