This concludes staff comments at this time. In order to stay on
schedule for the October 25, 1993 Planning and Zoning Board
hearing, please note the following deadlines:
Plan revisions are due October 6th, 1993 by 12:00 noon.
PMT's, colored renderings, and 10 prints are due Oct. lath.
Final mylars'and other documents are due October 21st.
Please be aware that if a development agreement and utility
plans are required with this project, these documents and
plans must be signed prior to the Planning and Zoning Board
Hearing. If not, a condition will be placed on the project
giving you 60 days to finalize the plans and agreement, after
which time, you must submit a request for an extension from
the Planning and Zoning Board.

10. The point of beginning shown does not match the description
and to match the description the tie from the NE corner to the
section line should.be shown.
11. It is not mandatory, but for the convenience of builders, etc.
it would be nice to know how far the easement across the rear
of the lots is from the rear lot line:
12. The two ROW lines of Evenstar Court are not parallel, please
show a ROW width at the P.C. of the Curve near the S.E. corner
of Lot 5.
13. The pedestrian connection to the senior center should be shown
with a ramp, this will also serve as the access point to the
sidewalk system'for users of the handicapped parking space.
14. New dwelling units are subject to parkland fees when building
permits are issued. All landscaping in the public right -of- -- --.
way shall be maintained by the Homeowner's Association.
15. Parks and Recreation has concerns about drainage. The
proposed detention pond off -site is on City owned property and
has not yet been approved by Parks and Recreation. I will
schedule a meeting to discuss this issue with Parks, Planning,
Stormwater, and Natural Resources. The Planning and Zoning
Board also had concerns about using City property for private
benefit. Parks and Recreation will discuss participation in
construction of a pedestrian bridge over the canal to the west
of the Senior Center site. Staff recommends that this issue
be resolved prior to the Planning and Zoning Board hearing.
There is a possibility that if this is unresolved, the project
will be delayed.
16. Natural Resources has requested that any landscaping in the
natural area between the two ditches should be native species
and should be coordinated with the landscape plans for the
Senior Center and The Preserve. They would like to review the
landscape plan for landscaping and habitat enhancement of this
area. Any proposed landscaping for this area should be shown
on the site/landscape plan and maintenance of the area should
be addressed.
17. Note number two should be updated to read "final plat"..
18. Transportation and Engineering have concerns about the design.

Dear Kay,
Staff has reviewed your submittal for Raintree Townhouses PUD-
Final and offers the following comments:
1. US West will provide telephone service in accordance with the
rates and tariffs on file with the Colorado Public Utilities
Commission. The developer is responsible for provision of all
trench; street crossings, and ditch crossings for telephone
facilities within the project, and the developer pays up front
construction costs for facilities within the development.
2. Any relocation of existing telephone facilities required by
these plans will be paid for by the developer.
3. Review of these plans should not be construed as a commitment
that telephone facilities sufficient to serve this project are
presently available.
4. The closest natural gas source of distribution pressure is at
the Shields and Raintree intersection. The developer will
have to obtain a utility easement either from the existing
private residence adjoining Shields Street, or from the Fort
Collins Senior Center for access for a gas line to serve this
development.
5. The.maintenance area on the south side of the New Mercer Canal
must be approved by the Canal Company. No bridges will be
allowed without written approval.
6. You can delete note number 3, because a variance is not needed
for Evenstar Court. It appears that a formal variance request
is not needed for single loaded 28' wide local streets.
7. For Water and Wastewater comments, please refer to the utility
plans. These have been forwarded to TST.
8. There were some questions about the plat. Are radii needed at
the Shields Street intersection? What does the bearing and
distance of "S89.56115"E 197.8211' along the south side of
Evenstar Court mean? Does it create another parcel or gap or
overlap into the Tract to the south?
