Dear Mayor Azari:
This is a follow-up to my December 24, 1996 letter to you explaining
that the action taken by the CitylCounci1 on December�17, 1996, to
annex and zone the above described property was in conflict with
Poudre Valley's Annexation Petition and Agreement, and that the
Annexation Ordinance 162, 1996 and the Zoning Ordinance 163, 19969
were also in conflict with eacA other. t j
I also requested that the City contact our General Manager, Mr. Ronald'
Carey, if you felt that the City could suggest aresolutionito these
issues that would comply with the Annexation Petition and Agreement.
I had further asked that if the City had a suggestion to resolve these
conflicts that you contact Mr. Carey before the Annexation and Zoning
issue was brought up on final consideration by the Counc ili (,
Inasmuch as the City did not approve our Annexation and Zoning
request, and has been non -responsive to Poudre Valley's efforts to
resolve these conflicts, the Council has, therefore, denied our
Annexation and Zoning request.
For purposes of moving forward with development of�our property in the 1
county, Poudre Valle yY REA)hereby withdraws its Annexation Petition to
the City of Fort Collins.!

Re: Withdrawal of the REA Annexation and Zoning Request
The Current Planning Department has received a copy of the letter (dated January 30, 1997)
from Norman Johnson, President of the Board of Directors of the Poudre Valley REA, to Mayor
Azari requesting that their annexation and zoning request be withdrawn at this time.
A City Council member has asked the following question:
If a development request is going to be submitted to the County, what zoning
designation will likely be requested by the owner (or under what zoning
designation will the development request be processed)?
Presently the REA property is in the B - Business (on the front 1/3, about 300' of lot depth) and
C - Commercial (on the back 2/3) Zoning Districts in Larimer County. Expressed interest in
redevelopment or reuse of this property has centered around an automobile dealership and
several unidentified "big box" users. Based on our interpretation of the County's Zoning
Resolution, it would appear that the current Districts would be most appropriate for the
proposed uses. Therefore, City staff thinks that the owner/applicant for development on the
property would submit plans that are permitted uses in the existing Zoning Districts and that the
County would process them in that manner. This assumption has been confirmed in telephone
conversations today with Russ Legg of the Larimer County Planning Department and John
Pedas, the County Zoning Administrator.
Also, City staff thinks that any rezoning or development request to Larimer County that requires
action of the Board of County Commissioners would trigger a requirement that the request be
referred to the City for annexation and development. This is based on our interpretation of the
Intergovernmental Agreement between the City and the County.
