New Mercer Ditch Company (Mail Creek Ditch Lateral)
Problems or Concerns:
1. The developer and HOA need to understand the ditch will continue to be maintained as it has
been historically, including but not limited to, burning, spraying, mowing, cleaning, etc. The developer
and/or HOA will not be allowed to mow or weed whack in the ditch ROW to ensure the ditch does not
become clogged with grass and weeds and cause flooding and to insure the ditch flow is not disturbed
by such activity.
2. Any bike paths within the ditch ROW will be driven on and have heavy equipment moved along
and across them in order to maintain the ditch.
3. Any pedestrian pathways located in the ditch ROW must be approved by New Mercer Ditch
Company.
4. The developer will need to discuss with the New Mercer Ditch Company Superintendent the
plans to get New Mercer water to the proposed park.
5. If the City of Fort Collins requires the developer to widen Timberline Road at Zypher, and
depending upon how long the turn lane is, the bridge may need to be replaced which will require
approval of plans by New Mercer and its engineer, at developer's expense, and a legal crossing
agreement, also at developer's expense.
