1. Compatible with Surrounding Uses: The proposed development is found
compatible with the following surrounding zoning and land uses:

2. Compliance with General Development Standards:
A. Plat standards
All lots have vehicular access to dedicated public access easements. No need
exists to dedicate any additional public right-of-way for either Harmony or
Timberline Roads. The Replat vacates old and dedicates new utility easements
for drainage and utility improvements as necessary to serve the proposed
developments.
B. Development Improvements
The improvements to Harmony and Timberline Roads are covered under an
existing Development Agreement executed in conjunction with the original Final
Planned Unit Development These improvements will be constructed in
accordance with the roadway classifications. This Development Agreement
between the Developer and the City will not be affected by this Replat. The
Replat will continue to obligate the developer for the standard Development
Guarantee and Maintenance and Repair Guarantees.
DECISION
The Harmony Village Planned Unit Development, Replat No. 3, #65-93G, is approved
by the Hearing Officer without conditions.

BACKGROUND AND ZONE DISTRICT: The property was annexed and zoned in 1989.
In 1993, the parcel was included in the 74-acre Harmony Crossing Overall Development
Plan. The 33-acre Preliminary Planned Unit Development was approved in November
of 1998 as a Community -scaled shopping center in accordance with the Amended
Harmony Corridor Plan. The Final Planned Unit Development was approved in
February of 1999. A Replat affecting Lots 1, 2, 3, 4, 5, 6, 10, 11 and 12 was approved
in June of 2000. A Replat and Major Amendment affecting Lot 9 will be considered by
the Planning and Zoning Board on February 15, 2001. The following approvals, in
chronological order, have been granted within the center:
Lot 10 - Cinemark Theatre
Lot 5 - Multi -tenant Building (Old Chicago Restaurant, Rubio's Restaurant)
Lot 7 - Multi -tenant Building (Noodles Restaurant)
Lot 6 - Schrader's Country Store and Carwash
Lot 11A - Texas Roadhouse Restaurant
The purpose of the Replat is to reconfigure the lots for the potential development of two
buildings. The immediate corner of Harmony and Timberline is proposed for the First
National Bank. This would be a one-story building with 10,500 square feet. The bank
would include six drive -through lanes.
The balance of the Replat is proposed for a one-story multi -tenant retail building with
15,900 square feet. These two development proposals are being processed
concurrently with the Replat as Minor Amendments to the original Harmony Village
Planned Unit Development
NOTICE OF PUBLIC HEARING AND NEIGHBORHOOD MEETING: Testimony or
evidence established that the property was properly posted, legal notice mailed, and
notice published. There was no requirement for a neighborhood meeting.
PUBLIC HEARING: The Hearing Officer, presiding pursuant to the Fort Collins Land
Use Code (LUC), opened the hearing at approximately 3:30 p.m. on February 9, 2001 in
the conference room of the City of Fort Collins Planning Department located at 281
North College Avenue, Fort Collins, Colorado.
RECORD OF HEARING: The Hearing Officer accepted during the hearing the following
evidence: (1) Planning Department staff report: (2) application and supporting
documents submitted by the applicant and the applicant's agents; (3) documents
submitted during the hearing; (4) a sign-up sheet of persons attending the hearing and
citizens speaking in favor or against the application; and (5) a tape recording of
testimony providing during the hearing.
FINDINGS AND CONCLUSIONS
The evidence presented to the Hearing Officer established facts supporting the
following findings and conclusions:

PROJECT DESCRIPTION: A request to replat Lots 1,2,3 and 4 of Harmony Village
Planned Unit Development into two larger lots. This replat would be the third replat
within this Planned Unit Development The affected lots are on the north end of the
Harmony Village Community Shopping Center located at the southwest corner of
Harmony and Timberline Roads. The purpose of the Replat is to reconfigure the lots to
accommodate a bank and a multi -tenant retail building. These lots are presently
vacant.
SUMMARY OF HEARING OFFICER'S DECISION: Approval without conditions.
