Dear Ted:
We represent the First National Bank (Bank) and have been involved in an
exchange of Lot 2 of Harmony Village PUD, Replat No. 1 (Bank Lot 2), previously
owned by the Bank, and portions of Lots 2, 3 and 4 of Harmony Village PUD, Replat
No. 1 (Bank Reconfigured Lot) previously owned by Dial of Fort Collins I, LLC (Dial).
The Bank and Dial closed that exchange on Monday, February 5, 2001, whereby the Bank
deeded the Bank's Lot 2 to Dial and Dial deeded the Bank Reconfigured Lot to the Bank.
Enclosed are copies of those deeds.
I'm enclosing a copy of the survey of the Bank's Reconfigured Lot, which will
become Lot 2A of Harmony Village PUD, Replat No.3, which is a replat presently
pending before the City Planning Commission. I'm also enclosing a copy of the proposed
and pending Replat No. 3. The description of the Dial/Bank deed for the Bank
Reconfigured Lot (to be Lot 2A) is the same legal description of the proposed Lot 2 A of
Replat No. 3.
The title company that closed the transaction, First American Heritage Title
Company, has informed us that it can issue a title policy from the issued title commitment
(copy enclosed) as soon as it obtains confirmation from the Clerk and Recorder of the
recording of the requisite documents. Pending receipt of that policy, I am sending you
this letter to certify on behalf of the Bank that the Bank is the fee simple owner of the
Bank Reconfigured Lot, which upon the City's approval of the Harmony Village PUD
Replat No. 3 will become Lot 2A of Harmony Village PUD, Replat No. 3.
