MAI OK You may recall that. I am the owner of the 32-acre SW corner of Harmony/Timberiine Road which is designated a "Community Shopping Center" land use in the Harmony Corridor Plan and in City Plan. A preliminary development plan for this property has been submitted for City review and feats a movie theater as the anchor. Considerable attention has been given both to creating a pedestrian orientation to the site design and to providing a wide range of users in an effort to reduce vehicle miles traveled by those frequenting time movie theater and other facilities, such as the proposed bank, drug store, and neighborhood retail establishments. lnchuied it ;his range of complementary uses is a fast food restaurant with a drive-duu, and it is this use which suddenly appears to be causing confusion. You are correct in recalling that four (4) retail centers along Harmony Road have already been reviewed and approved by the City using the updated Harmony Corridor Plan as the framework for this process. In every instance where a restaurant drive-thru window was proposed. it was approved by both the staff and P & Z Board: This includes two (2) such restaurants for the Harmony School Shops at the NE comer of I•iarmony/ Timbe±nine roads and one (1) for the Preston Center at the SW comer of Harmony Road and C.R 9. And yet despite the praise both these centers including drive-thru restaurants received from the staff and Board, a faction of the staff is now saying that their approvals by the City were "an oversight" and that the Harmony Corridor Plan prohibits such restaurants. Although the Harmony Corridor Plan does not appear to explicitly include or cxcludc a drive-thru component to a restaurant, this faction of the staff is saying that the Plan in fact "intended" to exclude this feature. Consequently, as a member of the Citiztns' Advisory Committee, your recollection of the Plan's intent regarding this subject couldbemeanhigful. 1� AEG 00 1060 sailor-, Reef Fort Collins, Colorado 8O52S • 303/226-6819 �f June 17, 1998 Mr. Les Kaplan y Regarding: your letter to Harmony Corridor Committee members We understand how the drive-in restaurant land use issue has caused confusion for you and we apologize for our mistakes which contributed to it. To help clear up any remaining confusion, we would like to reiterate in writing the information we have discussed in past telephone conversations. Specifically, two key points in your letter to the committee are not accurate. 1. It is no longer a faction of staff saying that drive thru's are not permitted. The whole staff now realizes that it was indeed an oversight to support the two centers with drive-thrus. It can be called a mistake or an "oversight" in quotes. But that is the fact of the situation. (How could there be such an oversight? Both projects came in during City Plan, in fact around the time of the Visual Preference Survey, and during that time Advance Planning did not keep up with Development Review. The Harmony Corridor Plan Update was fairly new and nobody else noticed the drive thru issue. That is the whole explanation of the previous approvals.) 2. The plan does indeed explicitly exclude drive-in restaurants. There is no confusion about this. The distinction between drive-in and fast food has been long established in zoning definitions, prior to the Harmony Corridor update and prior to City Plan. When defined uses are listed as permitted, they are permitted, and when they are not, they are not. This is how the zoning Code worked before and after the Harmony Corridor update. Whether or not any faction of staff thinks it was "intended", the list of permitted uses is clear. Sincerely, The Staff of the C P E S Division
