The purpose of this letter is to provide notice of development activity north of Harmony Crossing
P.U.D. that, if approved, will obligate Gateway American Properties to reconstruct the Rockport
Drive/Timberline Road intersection.
As you are aware, Mr. Les Kaplan, owner of Harmony Village P.U.D., has submitted a
development proposal for the 32 acre parcel north of Harmony Crossing P.U.D. at the southwest
corner of Harmony Road and Timberline Road. The development proposal is being submitted
through Dial Companies for a community -scaled shopping center that is proposed to be anchored
by a United Artist multi -screen movie theater and include other retail shops, bank, restaurant and
convenience store with fuel sales.
The preliminary plan calls for Delany Street to be extended north from the Harmony Crossing
residential neighborhood into the Harmony Village shopping center. Such an extension would
then provide an additional access point for Harmony Crossing which then allows the Rockport
Drive/Timberline Road intersection to be closed and re -constructed as a cul-de-sac.
The closing of the Rockport/Timberline Road intersection is spelled out in the Harmony Crossing
Development Agreement under Special Conditions, IL, D., 8, on pages seven and eight. I have
enclosed a copy of this Agreement for your records and highlighted the pertinent section.
The Harmony Village Preliminary P.U.D. has not yet been taken to the City of Fort Collins
Planning and Zoning Board for action. If the P.U.D. gains preliminary approval, it must then be
submitted for final and, again, would have to be considered by the Planning and Zoning Board.
Needless to say, this will take several months. Gateway American Properties will be notified of
these public hearings.
It is our hope that this letter and the attached Development Agreement will act as a gentle
reminder that when Delany Drive provides a second point of access, the Rockport
Drive/Timberline Road intersection will need to be closed. Hopefiilly, with sufficient lead time,
Gateway American Properties can act expeditiously and coordinate the intersection work with
extension of Delany Drive by the Dial Companies so that there is minimal disruption in the
