Although Dial Properties, Co. has been committed to creating a first class development
within the City of Fort Collins since our initial involvement, we are now requesting your
help in order to find a resolving compromise to meet both of our development objectives.
Specifically we are requesting your determination as to whether the recent interpretations
apply to our proposed development and to establish a reasonable timeline or schedule to
work through the city's approval process as efficiently as possible in order to complete
this project. I appreciate your assistance, and look forward to finalizing our development
with the City at the earliest opportunity.
Thank you for your attention to this issue and if you have any questions pertaining to this
matter please feel free to contact me at your earliest convenience.
Sincerely,
D RTIES, CO.

As you know, Dial Properties, Co. has proposed the above referenced development based
upon an "entertainment " theme including multi -screen theatre complex, restaurants,
service uses and specialty shops within the City ofFort Collins. Currently this
development is under review by the City Staffthrough the formal application of our
site / development plan which encompasses the above defined uses,
Dial Properties, Co., as has the City of Fort Collins, has expended large amounts of time
and economic resources over the past 14 plus months in order to coordinate all of our
efforts with City Staff to create a property development that both we as professional real
estate developers as well as the City of Fort Collins could be proud of.
Within the past thirty days however we have been notified that two interpretations now
exist with City Policy which may severely jeopardize our project. Accordingly, our
development is faced with the cancellation of three of our specific users under contract
Dial understands that the purpose of the City's approval process is to resolve the specific
development issues, however we realistically believe this contradiction sbould have been
revealed long ago.
