Thank you for your letter of October 21 regarding expansion of a detention pond for the
Harmony Village property on to Tract B of Harmony Crossing. It is our understanding that Imago
Enterprises, Inc. owns the Hamwny Village property to the north that your client is proposing to
purchase.
The Harmony Crossing Development Agrccment contains an obligation to close Rockport
Drive when Delany Drive is out through, but there does not appear to be any provision concerning
detention pond expansion or sharing detention facilities with the property to the north. In fact, the
Development Agreement provides that if storm drainage facilities are required to serve offsite areas,
these would be shown on the approved utility plans. The approved Harmony Crossing utility plans
show a detention pond north of Tract 13 "to be constructed by others," but does not show any
encroachment an to Tract B.
We believe the detention pond to serve the Harmony Village property should be constructed
so that historical flows will be maintained at the property line, without encroaching on to Tract B of
Harmony Crossing. Consequently, my client is not presently in a position to provide a letter of
intent to allow your client to expand its detention pond onto Tract B of Harmony Crossing. Please
call if you have any additional information or if you wish to discuss this matter further.
