Re: Harmony Village PUD, Fort Collins,— Proposed. Joint Access from Harmony
Road and Sidewalk Extension — Letter of Intent
Dear Gary:
As we have discussed, JR Engineering, Ltd. (JR) has' been retained to complete engineering
plans for the development of the commercial site at the southwest corner of Timberline and
Harmony known has Harmony Village PUD. As part of the development of Harmony Village
PUD, a joint access for the new development and the existing warehouse property will be
constructing eliminating the two access points that currently exist across your property. In
addition; anew sidewalk will be constructed along Harmony Road from the existing sidewalk
on the,ABB site to Timberline Road, including the section across your property.
As part of the development of the final plans for this site, our client, the Dial Companies, and
JR will continue to coordinate with you on issues including the following: The proposed joint
access, including allowing for tractor -trailers to access your site from Harmony Road (both
east bound and west bound); providing for the proper connections to your parking lot from
Harmony Village, PUD; providing for connections of your existing private sewer system into
the public system to be located on' Harmony Village, PUD; and keeping. the new sidewalk
within the existing 45 foot water easement along Harmony Road.
At this time, the Harmony Village PUD project is proposed to go to the City of Fort Collins
Planning and Zoning. Board for Preliminary approval at the end of November. As part of this
process, the City has requested that we secure a "Letter of. Intent' from the representatives of
the warehouse property for the above referenced work to be completed as it lies outside of our
site.
In order to streamline this process, please sign this letter below if you agree with the content
so we can forward it to the -City as part of our project package. Please be assured that this
Letter of Intent means only that you intend to grant easements to the Dial Company for the
above mentioned items. Formal easement documents (legal descriptions and exhibits) will be
provided for your review and signature as the information becomes more finalized.
