D. Future development of the property will be required to meet Land Use Code
Division 2.6 DEVELOPMENT CONSTRUCTION PERMITS; and, Division 2.7
BUILDING PERMITS.
DECISION
Based on the findings and conclusions, the request for the Waterglen PUD, Replat #1 is
approved with the following condition:
1. Prior to Director approval, the applicant will revise the plat to include cross access
easements between Tracts Q-1, Q-2 and P-1 consistent with the approved PUD and
subsequent minor amendments.
Dated this 8th day of June 2001, per authority granted by Sections 1.4.9(E) and 2.1 of
the Land Use Code.

shall be permitted until the subdivision plat is filed and recorded in the City of
Fort Collins.
B. The replat is in compliance with Section 3.3.1(B) Lots in that:
1) Each lot has direct vehicular access to a public and the side lot lines are
substantially at right angles or radial to the street lines.
2) The general layout of lots, roads, driveways, utilities, drainage facilities and
other services within the proposed development were established with the
approval, filing, and recording of Waterglen PUD. The design of the adjacent
platted roads is unaffected.
C. The replat is in compliance with Section 3.3.1(C) Public Sites, Reservations and
Dedications in that:
1) The rights -of -way for the adjacent streets (East Vine Drive and Waterglen
Drive) and the drainage and utility easements necessary to serve this area
were dedicated with the Waterglen PUD Subdivision plat that is on record in
the City of Fort Collins. The reconfigurations of the lots and tracts change the
shapes of the necessary access, utility, and drainage easements. The new
easement configurations continue to adequately serve the access, utility, and
drainage needs. All utilities currently using the existing easement
configuration have reviewed this request, and have no conflicts with the new
configuration.
FINDINGS AND CONCLUSIONS
After reviewing the staff report and the record of the public hearing, the Hearing Officer
makes the following findings and conclusions:
A. The Waterglen PUD, Replat #1 is subject to administrative review and the
requirements of the Land Use Code (LUC).
B. The Waterglen PUD, Replat #1 conforms to standards of the L-M-N zoning
district.
C. The Waterglen PUD, Replat #1 conforms to the applicable plat standards as put
forth in the Land Use Code.

The Overall Development Plan for this project was approved March 7, 1994 by the
Planning and Zoning Board. The PDP was approved in July of 1994.
2. Article 2 - Administration:
The request complies with the applicable requirements of the LUC, specifically the
procedural requirements located in Division 2.1 - General Procedural Requirements,
Division 2.2 - Common Development Review Procedures for Development Applications,
and Section 2.4 - Project Development Plan located in Article 2 - Administration.
3. Article 3 - General Development Standards:
The request complies with the applicable requirements of the LUC, specifically the plat
requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General
Development Standards.
A. The replat is in compliance with Section 3.3.1(A) General Provisions in that:
1) The subdivision plat will be filed and recorded only after having been
approved by the Director of Planning, with such approval evidenced in writing
on the plat and signed by the City Clerk.
2) No building permit or certificate of occupancy shall be issued for construction
of any new principal building or no act which changes the use of any building

PUBLIC HEARING
After reviewing the Staff Report and recommendation, a public hearing was held on the
subject application at 3:00 PM on May 29, 2001. The hearing was held in Conference
Room B at 281 North College, Fort Collins, Colorado.

PROJECT DESCRIPTION:
This request is to replat Tract P (Multifamily) and Q (Mixed Use) of Waterglen PUD
Subdivision into four tracts being call P-1, P-2, 0-1 and Q-2. The primary purpose of
this replat is to subdivide the floodplain from the rest of the parcel for insurance and
development permitting purposes. Once the floodplain is subdivided from the rest of
the parcel, the owners will not need flood insurance or a flood hazard development
permit to build. The replat also subdivides tract Q, the mixed -use parcel into two
parcels. The lots and tracts affected by this replat are all in the in the LMN (Low
Density Mixed Use Neighborhood) zone district.
