Councilmember Janett requested information on the status of negotiations to acquire a 16-acre parcel of land along Spring Creek for natural area purposes. Active negotiations are continuing. During discussions last Friday and Monday, we continued our attempt to structure an' - agreement that (1) achieves a "bargain sale" to the City, and (2) adds 2-3 additional acres of wetland to the area of.consideration. We hope to conclude negotiations this week and bring forward an acquisition proposal for Board recommendation and Council consideration. Ms. Janett asked about the status of the development approvals on the overall 35-acre tract. This week, the owner received approval on an Overall Development Plan for the 35-acre tract, and preliminary approval for a townhome project on a 6.2 acre portion of the site. The ODP approval does not constitutue a development approval that carries a density guarantee or grants a vested property right. The 16-acre parcel is identified as "single-family/resource protection" on the ODP. In fact, the entire 35-acre tract has a preliminary P.U.D. approval that was granted in August 1992 and is good for 3 years. The current owner sought to amend the ODP in response to (1) the City requirement to have an ODP in place for the entire parcel and (2) his desire to move forward with planning efforts in case the prospective sale to the City does not work out. I do not believe the owner is using a development proposal to unduly influence negotiations on the potential sale. He has been straightforward with me in all of our talks. He views the land planning effort as a prudent step to take in case a sale to the City does not occur. In summary, I am optimistic about reaching an agreement for the purchase within the next few days. If that occurs, we will bring the proposal\ before Council as quickly as possible, probably in early January. If you have questions about the potential at 221-6263'.
