access location in terms which relate the access to others in the
vicinity. I will provide this documentation both to the City and
to Phil for his file.
I hope that this clearly states the issues and decisions of
our meeting. Please review.my comments carefully, and recommend
additions/changes as you'see fit. Please contact me immediately,

regard to this issue, as some new information was provided to me
in our meeting which led me to see the proposed access location

issue of traffic impact. The unknown uses of the adjacent lots,
(with the lot 3 use being the only known use), poses a question
in regard to planning for the future. The less than standard
auxiliary lane design could create congestion along the highway
should future development of the lots be of high intensity.,
The Traffic Impact Study dated November 1, 1993 was
partially based upon traffic data provided by an earlier study
(Dec. 1982) which proposed uses of the property. Those uses and
their impacts appear to be reasonable. The question of access
for the 5 lots must be addressed with the current proposal for
development of only one of those lots. It appears that we have
arrived at an approach hereby we would allow moving the access to
the proposed location, while protecting the highway from future
negative impacts as a result of a variance from standard
auxiliary lane geometry. A minimum distance from College Avenue
shall be established for the indirect connection of the Best site
to the access drive. That distance shall provide for anticipated
storage for left -turning vehicles from the access into lot 5.and
the Best site to the south., In addition, approval of -future
development of the remaining 4 lots shall hinge upon
compatibility with the original traffic impact analysis. A copy
of that document should be provided for my file. The document
shall also 'be included in the access permit which is .to be
written for this development. Matt Delich has provided to me the
volume which was originally reviewed and which appeared
acceptable for the overall property. That quantity appears to be
6235 trips per day to be generated by the Boardwalk Crossing
site. The Department and the City shall agree upon any increase
of impact which would be proposed.in the future. An increase in
overall impact which is deemed to present a safety and
operational problem could result in the closure or reconstruction
of the access which is anticipated for the REI development. These
two requirements must be clearly defined and stated in writing on
the plat for the REI site, and on all other future plats for all
lots of the Boardwalk Crossing property.
As we discussed, the SCACP specifies that "minor
adjustments" in locations of allowed accesses may be made. The
term "minor" is appropriate for a move which does not effect the
operation of any other access which exists or is anticipated, and
for a move which will result in safer access operation. In
discussion with Phil Demosthenes this date, we determined that
some written notice/explanation of such a minor move should be

Dear Steve,
This correspondence is provided as a written record of our
January 14, 1994 meeting held at your office in order to discuss
the possibility of moving the allowed .right-in/right-out.access

development'proposal`for 16t 3" has shown the-access'at a location
which is approximately 180 feet north of the location indicated
in the South College Access Control Plan (SCALP), and would
result in a 130 foot reduction in the minimum 'auxiliary
lane/taper length required by the State Highway Access Code.
. The access control plan was designed to provide for future
accesses which would safely serve multiple properties. The
access as located in the SCALP would be positioned along the
south border of 5 undeveloped lots, and would abut.the north edge
of the existing Best store site. As revealed in our meeting, the
Best owners have been assured a future access to their site
through the property to the north. The Best store was
constructed at a less than desireable distance from College
Avenue. Due to the proximity of the building to the highway, it
is desireable that circulation be moved to the north a reasonable
distance. Circulation from College immediately into the Best
parking lot could cause -conflicts of traffic along College
Avenue.
