It does not seem to be appropriate to provide a complete design of the detention pond based on one set of criteria at substantial cost to our client and substantial time involvement by the City of Fort Collins staff to review and comment, with a complete redesign (with additional costs to our client and addditional staff time involvements) based on potential changed criteria as a result of a revised study due February 11, 1994. 4. It is proposed that the preliminary submittal and approvals by the City be continued on the current time schedule. No final approvals to occur until all drainage issues have been addressed, designed, and approved. Our client understands that these final issues could delay the project another month during the final process, or until the subsequent approving cycle by the City. Ted, we are requesting that the Preliminary Submittal be considered for approval at this time. I believe the above request is in conformance with the discussions you, Roger Prenzlow and I had in your office on Thursday, December 30, 1993. All issues will be addressed to the satisfaction of the City's staff on or prior to any final approvals at the Final Subdivision Plat stage. On October 28, 1993, the undersigned met with Mr. Bouchard at the project site to discuss basically two issues: 1.) storm water drainage from Mail Creek onto his property, and 2.) irrigation ditch laterals and personal water rights owned or operated by Mr. Bouchard. During my conversation with Mr. Bouchard; he was adamant that no additional drainage be allowed to enter into his property (only historic flows), he did not want an increase in size of structure to allow additional flows (e.g. 4' x 6' reinforced concrete box culvert) to enter his property, and he owned water rights being transported by pipe and open channel flow in Mail Creek which are not to be altered. These issues all occurred at the end of October, 1993, the flows in Mail Creek should have been revisited and a final determination of final design values determined. We are now into January, 1994 and have received the above referenced PROJECT COMMENT SHEET stating that this project will be either delayed or stopped based on two issues: Detailed design of either onstream or offstream detention pond prior to receipt of the final determinations of a hydraulic study which has been recently commissioned for by the City of Fort Collins. The results of which will not officially be available until the end of January, 1994, or officially available for our use until approximately February 11, 1994. Based on the comments by Stormwater Utility, the detention pond is to be designed at this time based on values determined in a previous report. 2. Drainage improvements at the intersection of Crest and Harmony need to be included in the study. An attachment from the current Mail Creek drainage study indicating the requirement of a 4' x 8' reinforced concrete box culvert (this size of box culvert is different from the one specified in the Concept Review Comments of August 23, 1993 and of my discussion, with Mr. Schlueter on. October 15, 1993).. Based on the above facts, we are requesting that the Preliminary Submittal phase not be delayed pending results of a revisit of the Mail Creek hydrology/hydraulic study, currently commissioned to be performed by RBD Engineering for the City of Fort Collins. This request is being made based on the following: 1. The revisit to the Mail Creek drainage issue should have been initiated approximately two months ago when the issue was recognized. Our firm would have been more than willing to perform that study at that time and not delayed this project. 2. Union Blvd., Suite 202 Colorado Springs, Colorado 80918 (719) 593-2593 • FAX (719) 528-6613 This letter is in response to the PROJECT COMMENT SHEET, prepared on December 30, 1993 by Mr. Basil Hamdan of the Stormwater Utility Department of the City of Fort Collins. The submittal of December 6, 1993 was a preliminary submittal focusing on the conceptual planning stages of a subdivision development and not on final detailed construction plans. Discussions were held with Mr. Glen Schlueter of Stormwater Utility on October 15, 1993 relative to the requirements of the Mail Creek drainage basin. Two significant questions were asked by the undersigned of Mr. Schlueter as follows: Q. Are the 4' x 6' box culverts under Harmony Road and Crest Road manditory, or can reduced sized structures be utilized? A. The 4' x 6' concrete box culverts are required unless otherwise proven by additional hydraulic study of the Mail Creek basin that reduced or increased structures are required. 2. Q. Can onstream detention be utilized on Mail Creek immediately east of Crest Road, as opposed to offstream? A. Yes, onstream detention can be used if properly designed. On October 27, 1993, the undersigned received a telephone call from Mr. Glen Schlueter at which time Mr. Schlueter told the undersigned that he had had conversation with Mr. Joe Bouchard (downstream property owner - immediately east of Crest Road on the Mail Creek drainage). During this conversation with Mr. Schlueter, Glen stated that a revisit of the hydrology/hydraulics of Mail Creek by possibly the City of Fort Collins or JR Engineering, Ltd. should be accomplished 32700102.LET
