Subject: Indian Hills Village PUD - tree protection, drainage swale, grading
A situation has arisen recently that centers around the thinning and pruning of existing Siberian Elm trees along the
west property line of the development, the construction of a trench with buried pipe and a drainage swale, and the
finish grading for an area to contain several lots and homes. Indian Hills Village is on the south side of East Stuart
Street just east of Spring Park and west of Stover Street.
Tim Buchanan and Ralph Zentz of the City Forestry office and myself met with Ron and Dorothy Follett (Busch Court
residents) at Indian Hills on Wednesday, May 22nd, to evaluate the work going on pertaining to the tree trimming
and thinning of the trees along the west property line. A "tree protection zone" agreement is part of the Indian Hills
Village PUD approval and the requirements are*stipulated in the development agreement for the project, as well as
being included on the Landscape Plan and utility plans. This agreement sets forth the nature of construction and
disturbance that can take place within . It was determined that the appropriate City staff should meet on -site on
Thursday morning, May 23rd, to inspect the digging of the trench for an underground pipe.
The following City staff were present at Indian Hills at 9:30 a.m. on Thursday, May 23rd:
Ralph Zentz - City Forestry
Mike Herzig, Ward Stanford, and Steve Bigler- City Engineering
Basil Harridan - City Stormwater
Steve Olt - City Planning
In addition to City staff there were a number of residents of the area and the developer's foreman/supervisor present.
The contractor's crew for the project was on -site and in the process of digging the trench. They had already dug
approximately 100 to 150 lineal feet of trench (with the entire trench to be approximately 560 feet in length). It was
determined that the location of the trench that was dug was not in compliance with the agreement and utility plans
and, therefore, a Stop Work order was issued by Ralph Zentz and given to the developer's foreman.
Action to be taken as a result of the Stop Work order is for the contractor to resurvey the area and stake it in the
field. A meeting has been scheduled for 8:00 a.m., Tuesday, May 28th, on -site. City staff will meet with the
contractor to inspect the staking and hopefully make a decision on whether an acceptable solution can be arrived at
to mitigate the concerns and enable the City to lift the order. Several residents of the Busch Court neighborhood
have been notified of this meeting and have been told that they are welcome to attend.

A meeting was held at Indian Hills Village PUD this morning (5/28/96) to inspect the work being done on the west
side of the development. Present from the City were Tim Buchanan, Ralph Zentz, Mike Herzig, Basil Hamdan, Tess
Heffernan, and Steve Olt. Jeff Butler of Wonderland Custom Builders, representing the developer, and several
residents of the Busch Court neighborhood were also present.
A "Stop Work" order had been placed by the City on 5/23/96 for the trench digging and pipe laying activity along the
west side of the development because it was determined that the trench was being dug in the wrong location, too far
to the west. The required 10' separation between the existing trees and the west edge of the trench was not being
met. Mr. Butler had the area resurveyed and staked over the weekend. The current field -staking indicates that the
new trench to be dug will maintain a minimum of 10' between the bark of the trees and the closest edge of the
trench. The "Stop Wok" order was lifted by Ralph Zentz at this meeting, enabling the contractor to resume work in
this area when weather permits.
There are still questions about the finish grade, earthen berming, and drainage swale in this area, relative to the
adjacent neighborhood, that City Stormwater Utility, Engineering, Forestry, and Planning staff are working with the
neighbors on.
