RE: Indian Hills Village / Ten Foot Utility - Alley Easement East of
Property
1) From a practical standpoint, it would be desirable to underground these
utilities and give the Indian Hills Homeowner's Association the
responsibility for maintaining this "landscaped" area.
2) Likelihood / accelerated schedule for underground of these utilities? It
will, of course, be impossible to underground these later.
3) Vacation of ten foot strip
a) How quickly can this be done? We don't want to bother with this
if it is likely it will slow down our development.
b) Does this ten foot strip represent a "vacated right of way"? That
is, is it presently owned by the City? If so, who does the vacated property
go back to? Us or the adjacent owners to the east?
4) In the alternative, City would continue ownership of the property and
we could enter a maintenance agreement with the City, although I think
this alternative would be less desirable.
5) In your opinion, should we aggressively pursue these or forget the issue
because of the anticipated hassles and delays it may cause?
