OF THE PLANNING AND ZONING BOARD OF THE CITY OF FORT COLLINS
ABANDONING A PORTION OF THE INDIAN HILLS WEST P.Q.D. AND
A PORTION OF THE INDIAN HILLS VILLAGE P.Q.D.
WHEREAS, the owner of Lot 108 and a portion of Tract A of the
Indian Hills West P.U.D. and a portion of Tract A of the Indian
Hills Village P.U.D. has requested abandonment of the rights to
develop said lot and portions of said tracts in accordance with the
approved planned unit developments for Indian Hills West P.U.D. and
Indian Hills Village P.U.D.; and
WHEREAS, pursuant to Section 29-527 of the Code of the City,
the Board has considered said request and has determined that the
portions of the Indian Hills West P.U.D. and Indian Hills Village
P.U.D. which remain developed or to be developed in accordance with
the previously approved P.U.D. plans will continue to qualify for
approval as a planned unit development pursuant to the criteria and
requirements of Section 29-526 of the Code; and
WHEREAS, the Board has further determined that in so approving
the aforesaid abandonment, the City's rights of ownership of or
practical ability to utilize any previously dedicated street,
easement, right-of-way, or other public area or public property
will not be denied or diminished to the detriment of the public
good.
NOW THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS, that, pursuant to Section 29-
527 (a) (2) , Lot 108 and a portion of Tract A of the Indian Hills
West P.0 nd a portion of Tract A of the Indian Hills Village
P.U.D. are here emoved from said planned unit developments and
the r hts to deve ment said property in accordance with the
approved Indian Hills est P.U.D. and the Indian Hills Village
P.U.D. plans is hereby a andoned.
Passed and adopted at a regular meeting of the Planning and
Zoning Board of the City of ort Collins held this day of May,
A.D. 1995.

RE: Resolution PZ95-12
Steve, attached is the draft resolution which you presented to me for review, with one change that
I have noted on the Resolution. That change recommends the attachment of an Exhibit "A", and an
Exhibit "B" for the purpose of more particularly describing the lands to be removed from the existing
P.U.D.'s. I had envisioned that Exhibit "A" would describe Lot 108 and the "portion" of Tract A of
the Indian Hills West P.U.D., while Exhibit "B" would describe the portion of Tract "B" of the
Indian Hills Village P.U.D.
