PETITION FOR ANNEXATION
The undersigned hereby petition the Council of the City of Fort Collins, Colorado, for the
annexation of an area, to be referred to as the . -i- e -mr< ll , /_ aa;l r
Annexation to the City of Fort Collins. Said
area, consisting of approximately (�) acres, is more particularly
described on Attachment "A", attached hereto.
The petitioners allege:
1. That it is desirable and necessary that such area be annexed to the City of Fort
Collins.
2. That the requirements of Sections 31-12-104 and 31-12-105, C.R.S., exist or have
been met.
3. That not less than on -sixth (1/6) of the perimeter of the area proposed to be
annexed is contiguous with the boundaries of the City of Fort Collins.
4. That a community of interest exists between the area proposed to be annexed and
the City of Fort Collins.
5. That the area to be annexed is urban or will be urbanized in the near future.
6. That the area proposed to be annexed is integrated with or capable of being
integrated with the City of Fort Collins.
7. That the petitioners herein comprise more than fifty percent (50%) of the
landowners in the area and own more than fifty percent (50%) of the area to be
annexed, excluding public streets, alleys and lands owned by the City of Fort Collins.
8. That the City of Fort Collins shall not be required to assume any obligation
respecting the construction of water mains, sewer lines, gas mains, electric service
lines, streets or any other services or utilities in connection with the property
proposed to be annexed except as may be provided by the ordinances of the City
of Fort Collins.
Further, the petitioners consent pursuant to Section 37-45-136(3.6), C.R.S., to the inclusion
of such property into the Municipal Subdistrict, Northern Colorado Water Conservancy District
Petitioners reserve the right to withdraw their request for annexation until date of approval.
WHEREFORE, said petitioners request that the Council of the City of Fort Collins
approve the annexation of said area. Furthermore, the petitioners request that said area be
placed in the /[i Zoning District pursuant to Chapter 29 (Zoning) of the Code of
the City of Fort Collins.

recommending approval of the annexations with the following

The applicant, the City of Fort Collins, for the Sherman -Lawler
First Annexation is requesting that this property be placed in the
RP - Planned Residential District with a P.U.D. condition. The RP
District is for areas planned as a unit to provide variation in use
and building placement. The property is currently Larimer County
road right-of-way for Spaulding Lane.
The applicant, Sandcreek Associates LLC, for the Sherman -Lawler
Second and Third Annexations is requesting that the property be
placed in the RP - Planned Residential District. The RP District is
for areas planned as a unit to provide a variation in use and
building placement. Staff is recommending that this property be
placed in the RP - Planned Residential Zoning District with a
P.U.D. condition. The property is currently being used as a large
acreage single family residence.
Effective January 15, 1993, the Residential Neighborhood Sign
District was established to regulate signage of non-residential
uses in areas of the City which may be impacted by signage because
of their predominantly residential use or character. The district
includes neighborhood service centers, neighborhood convenience
shopping centers, business services uses, and auto -related and
roadside commercial areas that are in proximity to existing or
planned residential areas. For those developments located within
the district, the Planning and Zoning Board will review the
location of all proposed corral signs. Staff is recommending a
condition stating that the property known as the Sherman -Lawler
First, Second, and Third Annexations be placed in the Residential
Neighborhood Sign District and be subject to all limitations and
requirements of the district as defined in Sections 29-593 and 29-
593.1 of the City Code.
Findings:
1. The annexation of this area is consistent with the policies
and agreements between Larimer County and the City of Fort
Collins contained in the Intergovernmental Agreement for the
Fort Collins Urban Growth Area.
2. The area meets all criteria included in State law to qualify
for a voluntary annexation to the City of Fort Collins.
3. On February 1, 1994, the City Council considered and approved
a resolution determining that the proposed annexation is in
compliance with State law. The resolution also initiates the
annexation process for this property by establishing the date,
time and place when a public hearing will be held regarding

Backaround:
The applicant for the Sherman -Lawler First Annexation and Zoning,
being the City of Fort Collins, has submitted a written petition
requesting annexation of 0.7416 acres located on the east side of
North College Avenue and Terry Lake Road between Country Club Road
and Carryall Lane. The applicant is requesting that this property
be placed in the RP - Planned Residential Zoning District with a
P.U.D. condition. The property is currently Larimer County road
right-of-way for Spaulding Lane and is zoned FA - Farming in
Larimer County. This is a 100% voluntary annexation.
The applicant for the Sherman -Lawler Second and Third Annexations
and Zonings, being Sandcreek Associates LLC, has submitted written
petitions requesting annexation of 20.6942 acres (Second Annexation
= 12.4540 acres, Third Annexation = 8.2402 acres) located on the
east side of North College Avenue and Terry Lake Road between
Country Club Road and Spaulding Lane. The applicant is requesting
that the property be placed in the RP - Planned Residential Zoning
District. The property is currently being used as a large acreage
single family residence and is zoned C - Commercial, FA - Farming,
and M1 - Multi -Family in Larimer County. These are 100% voluntary
annexations.
The property is located within the Fort Collins Urban Growth Area.
According to policies and agreements between the City of Fort
Collins and Larimer County contained in the Intergovernmental
Agreement for the Fort Collins Urban Growth Area, the City will
agree to consider annexation of property when the property is
eligible for annexation according to State law. The property within
the Sherman -Lawler First Annexation gains the required 1/6
contiguity to existing City limits from a common boundary with the
Carryall Heights Annexation to the south; the property within the
Sherman -Lawler Second Annexation gains the required 1/6 contiguity
