Conol • / EAST VINE DRIVE ITEM: NOKOMIS SUBDIVISION Final 01 NUMBER: 8-94A Nokomis subdivision - Final, #8-94A May 23, 1994 P & Z Meeting Page 5 agreement, the running of time for the filing of an appeal of such "final decision" shall be counted from the date of the Board's decision resolving such dispute. Nokomis Subdivision - Final, #8-94A May 23, 1994 P & Z Meeting Page 4 Staff is recommending a condition of approval stating that: 1. The Planning and Zoning Board approves this planned unit development final plan upon the condition that the development agreement, final utility plans, and final P.U.D. plans for the planned unit development be negotiated between the developer and City staff and executed by the developer prior to the second monthly meeting (July 25, 1994) of the Planning and Zoning Board following the meeting at which this planned unit development final plan was conditionally approved; or, if not so executed, that the developer, at said subsequent monthly meeting, apply to the Board for an extension of time. The Board shall not grant any such extension of time unless it shall first find that there exists with respect to said planned unit development final plan certain specific unique and extraordinary circumstances which require the granting of the extension in order to prevent exceptional and unique hardship upon the owner or developer of such property and provided that such extension can be granted without substantial detriment to the public good. If the staff and the developer disagree over the provisions to be included in the development agreement, the developer may present such dispute to the Board for resolution if such presentation is made at the next succeeding or second succeeding monthly meeting of the Board. The Board may table any such decision, until both the staff and the developer have had reasonable time to present sufficient information to the Board to enable it to make its decision. (If the Board elects to table the decision, it shall also extend the term of this condition until the date such decision is made.) If this condition is not met within the time established herein (or as extended, as applicable), then the final approval of this planned unit development shall become null and void and of no effect. The date of final approval for this planned unit development shall be deemed to be the date that the condition is met, for purposes of determining the vesting of rights. For purposes of calculating the running of time for the filing of an appeal pursuant to Chapter 2, Article II, Division 3, of the City Code, the "final decision' of the Board shall be deemed to have been made at the time of this conditional approval; however, in the event that a dispute is presented to the Board for resolution regarding provisions to be included in the development Nokomis Subdivision - Final, #8-94A May 23, 1994 P & Z Meeting Page 3 4. Transportation: This development will be accessed by one 36' wide local street cul- de-sac that connects to Redwood Street (a designated collector street). The cul-de-sac is 600' in length and serves all 21 lots. There will be attached sidewalks on both sides for the entire length of the street. 5. Storm Drainage: There is a Stormwater Utility easement, for an existing stormwater detention facility, that impacts the rear of Lots 11, 12, and 13. This easement is presently maintained by the property owner. There is a 20' wide drainage ditch easement, for stormwater conveyance, on the rear of Lots 10 and 11 that is presently maintained by property owner. The City Stormwater Utility will eventually assume the maintenance responsibility for these easements. The utility has requested that the easements be dedicated to the City as a separate tract of land. The easements will become Tract B of the Nokomis Subdivision with this final plat. The condition of preliminary approval, stating that the existing Stormwater Utility easement located on Lots 11, 12, 13 and the 201 wide drainage ditch easement located on Lots 10 and 11 must be dedicated to the City Stormwater Utility, with the final Nokomis Subdivision Plat, as a single tract of land, has been met. RECOMMENDATION: Staff recommends approval of the Nokomis Subdivision, Final - #8- 94A, based on the following findings of fact: * This request complies with the requirements set forth in the RMP, Medium Density Planned Residential Zoning District. * This request is in substantial conformance with the approved Nokomis Subdivision, Preliminary. * The gross residential density for this proposal is 4.6 dwelling units per acre. * The condition of preliminary approval, stating that the existing Stormwater Utility easement located on Lots 11, 12, 13 and the 209 wide drainage ditch easement located on Lots 10 and 11 must be dedicated to the City Stormwater Utility, with the final Nokomis Subdivision Plat, as a single tract of land, has been met. Background• The surrounding zoning and land uses are as follows: N: RMP; vacant (planned multi -family residential in the Greenbriar Village P.U.D., Phase 4 - Overall Development Plan) S: RMP; existing vacant medical facility (New Beginnings, under new ownership) E: RLP; existing power substation, existing and planned single family residential (W.A.P.A., Evergreen Park, Greenbriar Village P.U.D., Phase 5 - Overall Development Plan) W: IL; existing limited industrial (Evergreen Park) The property was annexed into the City with the Pine Tree Park Annexation in November, 1972. The Planning and Zoning Board approved the Nokomis Subdivision, Preliminary on March 28, 1994 for 21 single family residential lots on 5 acres. 2. Land Use• This is a request for final subdivision approval for 21 single family residential lots on 4.59 acres located north of Conifer Street on the west side of Redwood Street. It is in substantial conformance with the approved Nokomis Subdivision, Preliminary. The gross residential density for this proposal is 4.6 dwelling units per acre. The lots range in size from 6,000 square feet to 10,922 square feet and comply with the requirements set forth in the RMP, Medium Density Planned Residential Zoning District. 3. Design: Landscaping: The developer will provide street trees at 40' on -center behind the detached sidewalk along Redwood Street. The adjacent homeowners (Lots 1 and 21) will be responsible for the on -going maintenance of the landscaping along Redwood Street. Also, the developer will provide one street tree per lot frontage within the development and all trees will be selected from the City's approved street tree list.
