RE: Strauss Cabin, Kechter Enclave, Trilby Substation and Friendly Fire enclave
annexations.
The purpose of this memo is to provide background information on the attached petitions for
enclave annexation and additional information regarding the City Manager's authority to sign the
petitions acting on the behalf of the municipal corporation.
Background
Authority
Section 2(g) of the Fort Collins Charter grants the City Manager powers to "perform such other
duties as may be prescribed by this Charter or required of the City Manager by the Council not
inconsistent with this Charter." Historically, the City Manager has acted on behalf of the
municipal corporation by signing annexation petitions such as the recent 2018, Water Treatment
Facility Annexation and numerous others over the years.
Annexation Eligibility
• The properties contained within four enclaves have been surrounded by the City for no
less than three years at which time the City has the legislative authority to unilaterally
annex the unincorporated land.
• The annexations are in compliance with agreements and policies contained within the
Larimer County and City of Fort Collins Intergovernmental Agreements and City's
Comprehensive Plan.
Next Steps
Upon signature of the annexation petition, the initiation of annexation proceedings will begin.
Completion of the four enclave annexations is expected to conclude in the first quarter of 2019.
