14. The long term operation of the intersection at South Shields

`p during the morning peak traffic. A deceleration lane on
westbound Harmony Road, into Westbury P.U.D., is recommended.

15. The utility plans are o.k. for preliminary review. The
cot comments that need to be addressed with the final P.U.D. have
been sent Stewart & Associates.
This completes the review comments at this time. Additional
comments may be forthcoming as the various departments and
reviewing agencies continue to review this request. Please be aware
of the following dates and deadlines to assure your ability to stay
on schedule for the April 25, 1994 Planning and Zoning Board
hearing:
Plan revisions are due April 6, 1994. Please contact as for the
number of folded revisions required for each document.
PxTvs, renderings, and a folded copies of final revisions (for the
Planning and Zoning Board packets) are due by 3:00 p.m. on April
18, 1994.

a. Parkland fees of $779 per dwelling unit will apply to
this request and will be collected at the time of

entity"? This note must state that the City will not be

two parts. If the "attached homes" Lots 1 through 20 are
townhomes then they are not subject to the Solar Orientation
Ordinance. The true single family Lots 1 through 56 would then
have to meet the ordinance on their own, probably requiring a
variance to the ordinance.

Staff has reviewed your documents for the Westbury P.U.D. -
Preliminary that was submitted to the City on March 7, 1994, and
would like to offer the following comments:
1. A copy of the comments received from U.S.West is attached to
this letter.

are adequate as shown (this is one to record in our memory
books!!!) and that no trees are to be planted within 4' of gas
lines.
/Jo R-o%` 3. Sharon Getz of the Building Inspection Department has stated
o. q�.tsfis that exterior walls of single family buildings located closer
D than 3 feet from the property lines must be of one -hour fire -
restive construction with no openings permitted. Parapets
extending 30" above the roof surface must be provided unless
exceptions to Section 1710 of the Uniform Building Code
(U.B.C.) are met. Projections may not extend over the property
lines and they must comply with Sections 504 and 1711 of the
U.B.C. Please contact Sharon at 221-6760 if you have questions
about the building code requirements.

Additional fire hydrants will have to be located on Westbury
Drive and near the cul-de-sac bulb on Belleview Drive (the

Each dwelling unit will have to have a dedicated electric
service. The City's required minimum separation between street
lights and street trees along West Harmony Road and South
Shields Street must be maintained. This is 40' for shade trees
and 15' for ornamental and evergreen trees.
6. A copy of the comments received from the Stormwater Utility is
attached to this letter. This comment sheet is dated March
�L.scd, 6 16th and it is apparently in the process of being revised.
Stormwater did not receive all of the needed documents, by

The Fort Collins -Loveland Water District and the South Fort Collins
Sanitation District have reviewed the above mentioned project and
have no objections provided all District requirements are
satisfied.
Please be advised that this property is not within the service area
of the South Fort Collins Sanitation District and, therefore,
sanitary sewer service is contingent upon the land being included
into the District boundary, which must be approved by the Board of
Directors.

Dear Steve:
Attached is a copy of your written comments letter for Westbury
P.U.D. with my responses penned in the margin or expanded upon
herein.
#8(D) I am showing this as a dedicated tract with the same
language that was used in the Lindimer subdivision.
The City would be the owner of this tract. We will
grade a maintenance road for the ditch company on the
east side of the ditch. This tract could be owned by
the homeowners' association if Parks desires and the
rights granted by easement.
10. Please tell me how this goes (solar variance) after the
work session. If the board members have a problem with
the "either townhomes or duplexes" language on the site
plan, I will agree to a conditional approval that
requires that these be duplexes and strictly comply
with the ordinance. It is critical to me to get a
preliminary approval at the April 25th meeting.
#11. Our plan provides 330' of contiguous R.O.W. to the
Thayer property which my traffic report indicates is
satisfactory. Their street can connect at any point.
If you would like me to dedicate the small triangle
east of Lot 35 as R.O.W., I will. We have noted the
future road connection and shared Shield access on the
site plan.

utility plans from your regular distribution. I
delivered plans, and Terry's review letter is attached.
