D. The pipe will be in a permanent recorded easement for
the benefit of your property until such time as your
property develops and the irrigation water is no longer
needed. My attorney will prepare the easement
agreement which will contain all of the above
stipulations for your review.
E. All of the above items will be at my sole expense.
I believe this summarizes the various issues. If you and Michael
think of other relevant things concerning this let me know. The
design and easement agreement will be done in June, I shall keep
in touch. All of this will be resolved to your satisfaction
before my final Planning and Zoning Board hearing.

Dear Alice:
This is to document the various conversations we have had
concerning the irrigation lateral that serves your property, and
to assure you that my Westbury P.U.D. will not adversely affect
your ability to irrigate your property. I shall copy Steve Olt
with this letter and request that he include it with his staff
memo to the Planning and Zoning Board so that it will become part
of the approval process record as you requested and document our
agreement. The April 25 Planning and Zoning Board meeting is for
hopefully a preliminary approval for Westbury P.U.D. I would
next submit for a final approval which would include engineering
and final design details on all aspects of the project, including
the underground pipe for your irrigation water.
Following is a brief summary of all of the things you have asked
for and that I hereby agree to do:
A. Westbury will underground your supply lateral across
the Westbury property in the greenbelt area and along
our side of our common property line to the present
ditch location on your property.
B. The pipe will be ADS or equivalent, with a trash grill
or grate across it at the .main ditch. There will be
cleanout points along the route at reasonable
intervals. We will work with Ed Wendel of the Pleasant
Valley and Lake Canal Company to size the pipe to
handle your needs. The City Engineering Department
will review and approve the design.
C. I will be responsible for any maintenance or damage
from leaking or seepage on the Westbury property until
the Westbury Homeowner's Association assumes this
responsibility. This will not be your responsibility.
