At the request of the property owner, this property was
annexed to the City of Fort Collins as part of the East Vine Drive
7th Annexation and zoned T-Transition, with conditions, on August
16, 1983. The property's use has been limited to farming and
livestock feeding at the level which existed in 1983, as a
condition of the annexation and zoning.
This petition to remove the property from the T-Transition
zone is made as the first step in determining a land use pattern
for the ultimate development of the property. The B-P Planned
Business zone was chosen because the variety of uses permitted in
such district will allow for flexibility in planning a mixed use
area, with a combination of residential and nonresidental uses.

The Northwest Quarter of Section 5, Township 7 North, Range 68
West of the 6th P.M., together with two (2) shares of the
capital stock of the Water Supply and Storage Company, excep-
tion, however, all lands South of the Larimer and Weld Ditch and
railroad right-of-way;
and
A part of the NE 1/4 of Section 5, Township 7 North, Range 68
West of the 6th P.M., described as follows: Commencing at the
NW corner of said 1/4 section, thence East 1756.10 feet, thence
South 2610.00 feet, thence West 1756.10 feet, thence North
2610.00 feet to place of beginning; EXCEPT right-of-way deeded
by Quit Claim Deed recorded in Book 171, at Page 454, and EXCEPT
right-of-way of small lateral ditch as now constructed and
County Road; ALSO, all that portion of land in the SE 1/4 of
Section 5, Township 7 North, Range 68 West of the 6th P.M.,
lying above the Larimer and Weld.Canal; ALSO a parcel of land in
the. SW 1/4 of the NE 1/4 and NW 1/4 of the SE 1/4 of Section 5,
Township 7 North, Range 68 West of the 6th P.M., described as
follows: Beginning at a point 30.00 feet East of the center of
said Section 5, thence South 390.00 feet parallel to North and
South quarter line to the right-of-way of the Larimer and Weld
Canal, thence Easterly .along right-of-way of said Canal 474.00
feet to a point 37.50 feet West of center line of the No. 8
Outlet Ditch, thence N 40'30'00"_.,W„740.00 feet and parallel to
Outlet Ditch to a point 30.00 feet East of the North and South
quarter line, thence South parallel to quarter line 255.00 feet
to point of beginning; ALSO, commencing at the NE corner of said
Section 5, thence South 2610.00 feet, thence West 883.90 feet,
thence North 2610.00 feet, thence East 883.90 feet to place of
beginning, together with all water and water rights, and ditch
and ditch rights and two irrigations wells located thereon and
adjudicated as Nos. 144491 and 2972-F.
Subject to all rights -of -way, easements, and restrictions as now
in use and of record.

RE: Petition to remove property from T-Transition Zone
Dear Ms. Krajicek:
our firm represents K&M Company. In accordance with Section
29-423 of the Code of the City of Fort Collins, please consider
this letter as a petition to remove certain properties owned by K&M
Company within the City limits from the T-Transition Zone. A copy
of the legal descriptions for these properties is attached as
Exhibit "A". The requested zoning for these properties is B-P,
Planned Business District.
I would request, per the above -referenced Code section, that
this petition be referred to the Planning and Zoning Board and
scheduled at its next regular meeting on March 28, 1994,'which is
at least 15 days from the date of the filing of this petition.
