KNOW ALL MEN BY THESE PRESENTS: That the undersigned, Westbury LLC, a Colorado
Limited Liability Company, being the owner of the following described land,
to -wit:
A tract of land situate in the Northeast a of Section 3, Township 6 North,
Range 69 West of the 6th P.M., City of Fort Collins, County of Larimer,
State of Colorado, which considering the North line of the said Northeast
a of said Section 3 as bearing N 89000'00" E and with a.11 bearings

An eighty (80.00) foot diameter circular shaped tract of land situate
in the Northeast I of Section 3, Township 6 North, Range 69 West of the
6th P.M., City of Fort Collins, County of Larimer, State of Colorado,
which, considering the North line of said Northeast a as bearing N
89°00'00" E, and with all bearings contained herein relative thereto,
is contained within the boundary lines which begin at a point which bears
S 89000'00" W 500.00 feet, and again S 00041'00" E 625.00 feet, and again
S 89000'00" W 113.83 feet from the Northeast corner of said Section 3,
run thence along the arc of a 40.00 foot radius curve to the right, with
a delta of 289°12'16", and an arc of 201.90 feet; thence N 89'00'00" E
46.34 feet to the point of beginning. The center of said curve bears
S 34023'52" W 40.00 feet from the point of,beginning.
It is understood by the undersigned that, by acceptance of this dedication,
the City of Fort Collins will not accept the duty of maintenance of such
easement.

9. Done. I hope to receive approval and start the First phase
in August and have lots ready by December. I plan on
collateralizing the landscape obligation if necessary
because there is no sense installing it until spring when
the first homes are complete.
10. I have previously met with Willis Smith, the President of
the ditch company, and discussed the various issues and
include my confirming letter herein. These ditch issues
will be addressed in the second phase. I have copied Judy
Martin, the new secretary, with the 2/17 letter and
discussed their needs for a crossing agreement and so on.
Willis confirmed that their easement need is 50 feet, not 40
feet like my 2/17 letter indicates. We have adjusted our
plat for lots 7 and 8 to accommodate this. I will
coordinate with Willis, and Ed Wendel, the ditch -rider, on
all construction issues when they occur in the next phase of
WESTBURY.
I have also added on the site plan "Future possible street
connection" at the end of Mariposa Court by the Neilon Property.
This ROW will be maintained by the Homeowner's Association until
developed.

Dear Steve:
Enclosed are the items requested in your 6/22 letter concerning
the WESTBURY P.U.D., First Filing Final submittal as well as my
responses to each numbered point:
1. I have spoken with Susan Peterson, the U.S. West
representative about this and we will work out a precise
location for this easement with the second Filing submittal.
This will not be a problem.
2. We have received comments from the water and sewer districts
and have made the revisions and will submit mylars for their
signature. I will work with Mike to petition the property
into their district, I have been aware of this.
3. Done.
4. Done.
5. I met with Roger Frasco and the name Mariposa is OK as were
our hydrant locations. He initialed by your comment which I
have included with this letter.
6. Done. Included herein is a copy of the fence exhibit that
will be part of the WESTBURY covenants.
7. Included.
8. Included. I have been working with Glen and Basil and have
also obtained an offsite easement that they requested across
the Front Range property. Glen tells me I should have no
problems. We still have not received Basil's comments on
our design, he assured me he won't pull me because the delay
has been his. We will respond quickly once comments are
received to have this wrapped up before the hearing.
