NOTICE
TO ALL PERSONS INTERESTED:
PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has adopted a
Resolution initiating annexation proceedings for the Robert Shields Second Annexation, said
Annexation being more particularly described in said Resolution, a copy of which precedes this
Notice.
That, on September 5, 1995, at the hour of 6:30 p.m., or as soon thereafter as the matter may
come on for hearing in the Council Chambers in the City Hall, 300 Laporte Avenue, Fort Collins,
Colorado, the Fort Collins City Council will hold a public hearing upon the annexation petition for
the purpose of finding and determining whether the property proposed to be annexed meets the
applicable requirements of Colorado law and is considered eligible for annexation. At such hearing,
any persons may appear and present such evidence as they may desire.
The City of Fort Collins will make reasonable accommodations for access to City services,
programs and activities and will make special communication arrangements for persons with
disabilities. Please call 221-6515 for assistance.

Section 3. That the Notice attached hereto be adopted as a part of this Resolution. Said
Notice establishes the date, time and place when a public hearing will be held regarding the passage V
of an annexation ordinance pertaining to the above described property. The City Clerk is directed
to publish a copy of this Resolution and said Notice as provided in the Municipal Annexation Act.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this

RESOLUTION 95-95
OF THE COUNCIL OF THE CITY OF FORT COLLINS
FINDING SUBSTANTIAL COMPLIANCE AND
INITIATING ANNEXATION PROCEEDINGS FOR THE
ROBERT SHIELDS SECOND ANNEXATION
WHEREAS, a written petition, together with four (4) prints of an annexation map, was
heretofore filed with the City Clerk requesting the annexation of certain property to be known as the
Robert Shields Second Annexation and Zoning; and
WHEREAS, the Council of the City of Fort Collins desires to initiate annexation proceedings
in accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the Council hereby accepts the annexation petition for the Robert Shields
Second Annexation, more particularly described as located in the County of Larimer, State of
Colorado, to wit:
A tract of land situate in the County of Larimer, State of Colorado, to -wit: A tract of
land situate in the Northwest Quarter of Section 33, T 7 N, R 68 W of the 6th P.M.,
Larimer County, Colorado. More particularly described as follows:
Considering the West line of the Northwest Quarter of said Section 33 as bearing N
00°00'00" E as determined by monuments found at the Northwest Corner and at the
West Quarter corner of said Section 33, and with all bearings contained herein
relative thereto.
Commencing at the Northwest Corner of said Section 33; thence along the West line
of said Section 33 S 00°00'00" E 1649.10 feet; thence departing from said line S
89033'00" E 1026.38 feet to the TRUE POINT OF BEGINNING; thence S 89°33'00"
E 648.07 feet; thence S 20°42'27" E 297.04 feet; thence N 90°00'00" W 314.20 feet;

Resolution 95-95 Finding Substantial Compliance and Initiating Annexation Proceedings for the
Robert Shields Second Annexation.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The applicant, Cityscape Urban Design, on behalf of the property owners, Mr. Robert W. Shields,
Mrs. Wendy L. Shields and Ms. Ilene E. Shields, has submitted a written petition requesting
annexation of approximately 6.07 acres located east of County Road #.9, and north of Hewlett-
Packard.
The proposed Resolution makes a finding that the petition substantially complies with the Municipal
Annexation Act and determines that a hearing should be established regarding the annexation.
Further. the Resolution directs the City to provide notice of the hearing. The hearing will be held
at the time of the first reading of the annexation and zoning ordinances. Not less than 30 days of
prior notice is required by Colorado law.
The property is located within the Fort Collins Urban Growth Area. According to policies and
agreements between the City of Fort Collins and Latimer County contained in the
INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH
AREA, the City will consider the annexation of property in the U.G.A. when the property is eligible
for annexation according to state law. The property gains the required one -sixth contiguity to
existing city limits from a common boundary with Robert Shields First Annexation and the Strachan
Annexation both located along the east property line. In addition, contiguity is gained on the north
with the Wild West Annexation.
If the Council passes the Resolution, the annexation and zoning process will proceed and the
Planning and Zoning Board will conduct a public hearing on the request for annexation and zoning
at its regular monthly meeting on July 24, 1995. At that time, the Planning and Zoning Board will
make a recommendation to City Council. The Board's recommendation will be forwarded to the City
Council in time for the public hearing and first readings of the annexation and zoning ordinances
scheduled for September 5, 1995. The Council's passage of the Resolution does not commit the City
to eventual approval of the annexation request.
If Council does not pass the Resolution, the annexation process will not proceed and the property
owner could then seek development through Larimer County.
