I feel the City has made an effort to work with the builder in good faith and the builder is not following through on his end of the deal. I hope if you decide to push this though, that it's done in the spirit of not having met an LDGS condition rather than making a big deal of pushing an energy requirement. I'd rather not see negative publicity regarding an onerous energy efficiency requirement -- I'd rather see publicity about a builder being asked to live up to development approval conditions. I'll be back in the office on 7 August. �t Utility . .:vices Light & Power City of Fort Collins MEMO DT: 22 July 1997 TO: Ted Shepard FR: Doug Swartz p(1� RE: 4027 Mesa Verde Dr. Here's a summary of what's occurred on this property to date relative to LDGS energy points: • I received a panic call from the builder, Alan James of Austin James Builders, in early March. He was completing this house, the first to be done in the Woodland Park Estates PUD. He had gone to B+Z to get the C.O. and was informed that there was a L+P hold on the property for ENERGY SCORE. He claimed this was the first he'd heard of the LDGS condition. • I described the G-80 requirement and told him he shouldn't have received a building permit without getting a ENERGY SCORE rating on the plans. But he had, so that was water over the dam. He agreed to have an ENERGY SCORE performed on the completed home. This was done by Jim Evenson. The score was G-77, I recall -- in any case a few points below the requirement. • The compromise we worked out, in consultation with B+Z, was to release the hold on the C.O. if the builder would agree to bring the score up to G-80 withing 90 days. See the enclosed memo from the builder to me promising this. In response to this, I released the hold and he obtained the C.O. • I called the other builder Iknew was building in the subdivision, Jeff Rittner of KEM Homes, to find out how he had learned about the ENERGY SCORE requirement. He sent me a copy of the covenants for Woodland Park, where the requirement is listed in black and white. I forwarded a copy of this to Alan James. • B+Z had simply made an error in releasing the building permit without the ENERGY SCORE. • Neither I, B+Z, or the rater had heard anything from the builder as the 90-day deadline came and went in early June. I left him a voice -mail on 13 June and sent a memo on 26 June. I arbitrarily requested documentation of the G-80 rating by 11 July. I have heard nothing yet. 700 Wood Street • P.O.
