Dear Dr. O'Halloran:
As you have requested through your building contractor, ADJAC Construction. this letter
addresses the general conditions attached to easements for water transmission mains
belonging to the City of Greeley.
1. Permanent structures shall not be built within easements. Permanent
strictures include anv structure which impedes the ability of, or places
additional cost burden on, the City of Greeley to install, replace, repair.
or Otherwise maintain the water line. Trees and bushes above the height
of three feet shall also be considered permanent strictures.
2. In the event of past easement encroachment the City of Greeley will
attempt to work around structures; however, the City of Greeley will not
be responsible for damages to private property within its easements.
Damages for which no liability is assumed by the City of Greeley include,
but are not limited to, the following examples: pavement. curbs. waLks.
trees, shrubs, or other facilities or suucrures which may ;geed to be
removed to allow access to the transmission mains. Restoration of
facilities or landscaping within easements shall not be the responsibiiiry of
the City of Greeley.
3. Property owners, contractors. and excavators are required to notify the
City of Greeley 48 hours in advance whenever any underground work is
being done in the vicinity of our water transmission mains. For water

The City of Greeley Water Department owns and operates a 27"
Water Transmission line that is located in your property. See
attached map for location. This water line is centered in a 50
foot easement. As indicated in the letter sent to you on
September 22, 1993, which is also attached, this easement
requires certain restrictions in order that the City can properly
maintain and operate our water transmission system in this area.
Any other properties in which the City operates a water
transmission system must adhere to similar restrictions and
widths of easement. Even through subdivision may occur in these
areas access must be provided for all excavation and repair
equipment.
We understand that this may impact certain development plans
however it is essential to the operations of the system to have
these restrictions.
