The property -owner, Robert Shields, of Item #30, the Robert Shields
Annexation and Zoning, has requested a tabling of the second
readings of the annexation and zoning ordinances to July 19, 1994,
because the contract purchaser of the property, a local development
company, has indicated they no longer have a desire to purchase and
develop the site. Mr. Shields would like to have some time to
think about continuing with the annexation process. Mr. Shields is
aware that development of the property would require eventual
annexation under the current provisions of the UGA Agreement which
states the County is prohibited from accepting a development
proposal on property which can voluntarily annex into the City.
The Wild West Annexation and Zoning, Item #32, will also need to be
tabled to July 19, 1994, because without the Robert Shields
Annexation the property fails to meet State annexation law
contiguity requirements to city limits. The property -owners of the
Wild West Annexation are aware of the situation and do not oppose
the tabling of their annexation.
The Strachan Farm Annexation and Zoning, Item #31, is not affected
by Mr. Shields' decision because the property gains the required
amount of contiguity from the Hewlett Packard property, to the
south, and the Spring Creek Farm Annexation, to the west.
Likewise, the Harmony Farm Annexation and Zoning, Item #33, is also
not affected by Mr. Shields' decision because the property gains
the required amount of contiguity from the Hewlett Packard
property, to the north, the South Harmony Annexation, to the west,
and the Ricketts Annexation, to the east.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE ZONING DISTRICT MAP CONTAINED IN CHAPTER 29
OF THE CODE OF THE CITY OF FORT COLLINS AND CLASSIFYING
FOR ZONING PURPOSES THE PROPERTY INCLUDED
IN THE ROBERT SHIELDS ANNEXATION TO THE
CITY OF FORT COLLINS, COLORADO
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows:
Section 1. That the Zoning District Map adopted pursuant to Chapter 29 of
the Code of the City of Fort Collins be, and the same hereby is, changed and
amended by including the property known as the Robert Shields Annexation to the
City of Fort Collins, Colorado, in the R-L-P, Low Density Planned Residential
Zoning District:
A tract of land located in the Northwest one -quarter of Section 33,
Township 7 North, Range 68 West of the 6th P.M., Larimer County,
Colorado, which, considering the West line of said Northwest one -
quarter as bearing due North, and with all bearings contained herein
relative thereto, is more particularly described as follows:
Commencing at the Northwest corner of said Section 33; thence South
1649.10 feet, and again S 89°33'00" E 50.00 feet to a point on the
Easterly right-of-way of County Road 9, said point being the TRUE
POINT OF BEGINNING: thence S 89°33'00" E 976.38 feet; thence S
00027'00" W 175.00 feet; thence S 89`33'00" E 62.53 feet; thence S
86000'00" E 80.50 feet; thence S 04°00'00" W 56.00 feet; thence S
51035'33" E 131.18 feet; thence S 00°00'00" E 383.07 feet; thence N
89036'40" W 1216.73 feet to a point on the Easterly right-of-way

Residential Neighborhood Sign District.
Section 3. That the zoning granted herein is expressly conditioned upon the
entire above -described property being developed as a planned unit development in
accordance with the Ordinances of the City.
Section 4. That the Director of Engineering is hereby authorized and
directed to amend said Zoning District Map in accordance with this Ordinance.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
ANNEXING PROPERTY KNOWN AS THE
ROBERT SHIELDS ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, Resolution 94-88, finding substantial compliance and initiating
annexation proceedings, has heretofore been adopted by the Council of the City
of Fort Collins; and
WHEREAS, the Council does hereby find and determine that it is in the best
interests of the City to annex said area to the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That the following described property, to wit:

Section 2. That, in annexing said property to the City, the City does not
assume any obligation respecting the construction of water mains, sewer lines,
gas mains, electric service lines, streets or any other services or utilities in
connection with the property hereby annexed except as may be provided by the
ordinances of the City.
Section 3. That the City hereby consents, pursuant to Section
37-45-136(3.6), C.R.S., to the inclusion of said property into the Municipal
Subdistrict, Northern Colorado Water Conservancy District.

Items Relating to the Robert Shields Annexation and Zoning.
RECOMMENDATION:
Staff recommends approval of the annexation and zoning request. Staff also
recommends the R-L-P Zone have a PUD condition attached. The Planning and Zoning
Board voted 7-0 to recommend approval of the annexation and requested zoning.
EXECUTIVE SUMMARY:
A. Second Reading of Ordinance No. 92, 1994, Annexing Approximately 18.4
Acres, Known as the Robert Shields Annexation.
B. Second Reading of Ordinance No. 93, 1994, Zoning Approximately 18.4 Acres,
Known as the Robert Shields Annexation, Into the R-L-P, Low Density
Planned Residential, District with a PUD Condition.
This Ordinance, which was unanimously adopted on First Reading on June 7,
approves the request to annex and zone approximately 18.4 acres located east of
County Road #9 and one-half mile north of Harmony Road. The property is
currently zoned FA-1 Farming in the County which allows single-family residential
development with a minimum lot size of 2.29 acres. The requested zoning is the
R-L-P, Low Density Planned Residential, District with a PUD condition. The R-L-P
District could allow for a variety of housing types and densities through the PUD
process, but due to the property's relatively small size a variety of uses is not
likely to occur. The property is presently undeveloped. This is a voluntary
annexation of property located in the Fort Collins Urban Growth Area.
