way for the neighborhood to get to the school, the new Westfield Park, and a collector
street network to the east. Therefore, the City supports the vacation of the old street
stub r.o.w. for Imperial Drive.
During our phone conversation, you indicated that the County may have some minor
capital funds to reimburse the developer for all or a portion of his costs in removing the
street stub. Typically, the City considers the work the developer's cost since it is part of
developing his property. I will leave it up to you if you want to negotiate a
reimbursement agreement with the developer.
Finally, you and I discussed the need to provide for future sewer service to Imperial
Estates which is now on septic systems. I notified Roger Buffington of the City's Water
Utilities of your request, and he will take this into consideration during his review of the
plans. Typically, the City Code requires developers to provide utilities to the property
line. If there is additional work the County would like to do at this time to extend the
mains into Imperial Estates within the existing r.o.w. or easements, I believe the
developer would be willing to work with you.to construct them at this time if you have
money available for reimbursement as you indicated.

Attached for your review and information is the site plan for the Westfield Park P.U.D.
As we discussed in our phone conversation of Friday, February 28, the project is
located on the south side of Horsetooth Road immediately adjacent to and east of the
Imperial Estates subdivision. The City has requested that the developer, Leo Schuster,
remove the street stub for Imperial Drive (highlighted on the site plan) so that it does
not remain a "no-man's land" of asphalt in a public r.o.w. that goes nowhere.
This is consistent with how similar situations have been handled in the City.
Developers are required to remove street stubs which they cannot or choose not to use.
The Developer must regrade, reseed, construct whatever sidewalk connections and
curb and gutter are needed, and install or remove utilities as needed to complete a
finished street frontage at the old intersection and a finished area within the old r.o.w.
The City withholds building permits for certain lots in the development until these
improvements are completed and accepted by the City. At that time, the street r.o.w. is
vacated subject to any utility, drainage, and/or access easements necessary to retain.
The City also requires that the developer obtain proof that the neighbors immediately
adjacent to the r.o.w. are in agreement with the proposed vacation prior to taking the
vacation request to City Council.
In this particular case; of course, the r.o.w is in the County. Therefore, the County
would be the entity to ultimately vacate the r.o.w. and must also approve of the
improvements to be completed in the old r.o.w. The developer has been told that he is
obligated for the removal of the street stub and completion of finished improvements as
part of the development of the Westfield Park P.U.D. The developer has stated that he
is willing to connect the street into his project, but, as you know, the Imperial Estates
neighborhood is strongly opposed to the idea. In addition, it is my opinion that if a
street connection is ever to be made from Imperial Estates to Seneca Street it makes
more sense to connect Westfield Drive since it is a less direct route out to Taft Hill Road
