Horsetooth Road Property As the owner of the property adjacent and on the East of the Stockbridge Development, I have concerns about my property. I am concerned that the Stockbridge developers will maintain all their construction on the west side of the boundary line and consequently, will'riot disruptor. disturb any of my property on the west side of the ditch. Of further concern are the easements they want for Horsetooth road and for the detention pond drainage. I do not want to give up anymore of my 8.37 acres than is absolutely necessary. Although, I certainly would be willing to sell the Stockbridge developers the ground east of their line and west of the ditch unless there is some reason I have to keep it for the ditch rider or some other reason unknown to me. Nassau Avenue Denver; CO 8023,7 lb Another of my concerns was at the planning board hearing, March 23, 1994: One of the speakers for the Stockbridge developer said my property was vacant, which I understood is a term some use for undeveloped land. Further, the impression was given that the property was practically abandoned, and it was indicated, no one knew who the owner was. I had been quite visible at the March 10, 1994 neighborhood meeting, introduced myself and following the meeting I talked to Leo Schuster, the developer of Stockbridge, Dennis Donnavan, the Stockbridge engineer and Steve Olt, City Planner for Stockbridge. There are several other easements planned for my property that have been mentioned to me, but appear not to be the planning board's responsibility. This property at 1401 W. Horsetooth Road has been in my family since 1946. I am a native and lived in Fort Collins until 1965, so I am also interested in Fort Collins, as well as, my own well being. Attached to this letter is a corrected copy of the letter mailed to Steve Olt, City Planner, previous to the hearing of the Planning and Zoning Board, May 23, 1994. Sincerely, Lois . Horsetooth Road, adjacent to and east of the Stockbridge Development Dear Mr. Phillips: As owner of the property at 1401 W. encroachment of my property. any concerns involving the I am protesting a bicycle path bejg situated on my property in my horse pasture. This bicycle path is not viable, considering, A woul cut my pasture in two parts and is proposed to be placed across the widest part of the p�stur . As long as my property is rental property, the path would be a hardship for me, since the ten o d be reduced drastically. If this bicycle path was situated across the middle of the pasture afd not a losed, it would be dangerous for people utilizing the path. Whether the path is fenced or not, it wo d be hazardous for the horses. If this path is installed, the present $bnant-would have difficulty ' 'gating this pasture. South of this said bicycle path, a large proportion of the horse pasture will be ithout drinking water for the horses. In no way, do I wish to have a public bicy a path allowing people the legal right to trespass back and forth across my property. Therefore, I m protesting the passage of the proposed aforementioned bicycle ath to be placed across or anywhere on my horse pasture or property now or later As long as I wn it. When this property is sold and developed, that will be the time to consider this proposal to if or where it/may be placed, as well as, the bridge over the ditch for this particular bicycle pa % I ways told by Steve Olt, the above bicycle path "probably" would not be built as long as I own the propty. I was ull�ware of the above andfollowing proposals until I attended the Hearing of the Planning and Zoning Board of the Ci of Fort Collins for the Stockbridge Development on May 23, 1994. These proposals ho ave been presented previously at the only Neighborhood Information meeting on March 10, 1994, or another meeting called for this purpose, or I should have been notified and informed previously to the hearing March 23, 1994. Consequently, I had no time to adequately prepare the presentation of my case to the Hearing of the City Planning & Zoning Board. Other proposals: 1. Bicycle path to be situated along the west side of ditch, which is also on my property. 2. Street across the middle of my horse pasture. This was not passed due to the protests of Skyline Acres. Nassau Avenue Denver, CO. 80237 Dear Ms. Burr, This in response to your letter to Ron Phillips, City of Fort Collins Planning Director, dated June 15, 1994, expressing your concerns about a bicycle path being situated on your property at 1401 West Horsetooth Road in Fort Collins. The action taken by the Planning and Zoning Board on May 23, 1994 requires Leo Schuster, the developer of the Stockbridge P.U.D., to dedicate an access easement only to his east property line to allow for a future bicycle/pedestrian trail that could connect the various neighborhoods with park and school facilities. This access easement will not impact your property unless it develops as something other than its existing use. At that time the City would negotiate with the property owner to provide an access easement for a bicycle/pedestrian trail across the property. Also, the City has asked Mr. Schuster to try and negotiate a bicycle/pedestrian trail along the west side of the Pleasant Valley & Lake Canal. Since this is partially on your property, he must work directly with you and the canal company to determine if this is feasible. Unfortunately, the need for these types of connections are not always identified until a development proposal is in the review process. In this case, Mr. Schuster was not aware of the City's request for a trail at the time of the neighborhood information meeting held on March 10, 1994. Thank you for making us aware of your concerns.
