If this condition is not met within the time established herein (or as extended, as applicable), then the final approval of this planned unit development shall become null and void and of no effect. The date of final approval for this planned unit development shall be deemed to be the date that the condition is met, for purposes of determining the vesting of rights. For purposes of calculating the running of time for the filing of an appeal pursuant to Chapter 2, Article II, Division 3, of the City Code, the "final decision" of the Board shall be deemed to have been made at the time of this conditional approval; however, in the event that a dispute is presented to the Board for resolution regarding provisions to be included in the development agreement, the running of time for the filing of an appeal of such "final decision" shall be counted from the date of the Board's decision resolving such dispute. Cottonwood Ridge Subdivision, #31-94A March 4, 1996 P & Z Meeting Page 4 As a standard subdivision, this proposal is subject to all the rules and regulations as set forth in Article III., Sections 29-146 through 29-148 and Article V., Sections 29-623 through 29-643 of the City of Fort Collins Zoning, Annexation and Development of Land Regulations. It is in compliance with the regulations. 2. This development is in conformance with the applicable City transportation policies. 3. The Final is in conformance with the Cottonwood Ridge Subdivision, Preliminary. 4. The Final addresses and meets the seven conditions of preliminary approval. 5. An access easement from the owner of the Westbury PUD, to the north, has been granted to allow street connections between the two developments. RECOMMENDATION: Staff recommends approval of the Cottonwood Ridge Subdivision - Final, #31-94A with the following condition: 1. The Planning and Zoning Board approves this planned unit development final plan upon the condition that the development agreement, final utility plans, and final PUD plans for the planned unit development be negotiated between the developer and City staff and executed by the developer prior to the second monthly meeting (April 22, 1996) of the Planning and Zoning Board following the meeting at which this planned unit development final plan was conditionally approved; or, if not so executed, that the developer or the City staff, at said subsequent monthly meeting, apply to the Board for an extension of time. The Board shall not grant any such extension of time unless it shall first find that there exists with respect to said planned unit development final plan certain specific unique and extraordinary circumstances which require the granting of the extension in order to prevent exceptional and unique hardship upon the owner or developer of such property and provided that such extension can be granted without substantial detriment to the public good. If the staff and the developer disagree over the provisions to be included in the development agreement, the developer may present such dispute to the Board for resolution. The Board may table any such decision, until both the staff and the developer have had reasonable time to present sufficient information to the Board to enable it to make its decision. (If the Board elects Cottonwood Ridge Subdivision, #31-94A March 4, 1996 P & Z Meeting Page 3 Bicycle/Pedestrian Trails: The developer will provide a 10' wide trail easement along the east '/z of the Pleasant Valley & Lake Canal (PV&L) easement. A note on the preliminary subdivision plat referencing an expiration date for the trail easement has been eliminated on the final plat; therefore, this condition of preliminary approval has been met. 4. Transportation: This development will gain primary access from South Shields Street at a point near the southeast corner of the property. There will be a series of streets and cul-de-sacs, internal to the site and designed as local streets, that will provide direct access to the lots and homes. A second point of access will be on a shared street (Westbury Drive) with the Westbury PUD directly to the north of this development. This street right-of-way is on the Westbury property but contiguous to Cottonwood Ridge, thereby enabling a local street in this development to connect to Westbury Drive. The City's Transportation Department has reviewed this proposal and considers this development to be feasible from a traffic engineering point of view. 5. Resource Protection: The ravine area at the south end of the Pleasant Valley & Lake Canal, bounded by Lots 7-10, 68-69, and Tract C, will be included in a conservation, drainage & utility easement and kept, essentially, in its present form. There were six conditions of preliminary approval and they were concerned with: a stability study for the PV&L and ravine area, potential stormwater runoff from this development into the PV&L Canal, conservation of existing vegetation to protect wildlife habitats, delineation of existing wetlands on -site, remedies for impacts to the wetlands caused by development, and execution and results of a rare plant survey. The conditions have been addressed and met. Findings of Fact/Conclusions: In evaluating the request for the Cottonwood Ridge Subdivision - Final, staff makes the following findings of fact: Cottonwood Ridge Subdivision, #31-94A March 4, 1996 P & Z Meeting Page 2 COMMENTS: 1. Background: The surrounding zoning and land uses are as follows: N: RLP; planned and existing single family residential (Westbury PUD) S: RLP; existing single family residential (Chelsea Ridge, The Ridge) E: RLP; existing single family residential (Clarendon Hills) W: RLP; existing single family residential (The Ridge) This property was annexed into the City with the Ridge Annexation in April, 1989. The Cottonwood Ridge Subdivision, Preliminary property was approved by the Planning and Zoning Board on July 25, 1994 for 71 single family residential lots on 34.3 acres. There were issues relating to required off -site utility easements, treatment of several existing irrigation laterals crossing the property, and treatment of the ravine area in the southwest portion of the property that were responsible for the time delay between the preliminary and final decisions. 2. Land Use: This is a request for final subdivision approval for 70 single family residential lots on 34.31 acres located on the west side of South Shields Street approximately one -quarter south of West Harmony Road. The gross residential density is 2.04 dwelling units per acre. As a standard subdivision, this proposal is subject to all the rules and regulations as set forth in Article III., Sections 29-146 through 29-148 and Article V., Sections 29-623 through 29- 643 of the City of Fort Collins Zoning Annexation and Development of Land Regulations. It is in compliance with the regulations. 3. Design: Landscaping: The developer will provide street trees at 40' on -center along the side lot lines, rear lot lines, and detention pond fronting on South Shields Street. The developer will provide a combination of plant materials, berming, and fencing as buffering along the rear and side lines of the double -frontage lots adjacent to South Shields Street.
