for the Stockbridge developer said my property was vacant, which I understood is a term some
use for undeveloped land. Further, the impression was given that the property was practically
abandoned, and it was indicated, no one knew who the owner was. I had been quite visible at the
March 10, 1994 neighborhood meeting, introduced myself and following the meeting I talked to
Leo Schuster, the developer of Stockbridge, Dennis Donnavan, the Stockbridge engineer and
Steve Olt, City Planner for Stockbridge.
There are several other easements planned for my property that have been mentioned to me, but
appear not to be the planning board's responsibility.
This property at 1401 W. Horsetooth Road has been in my family since 1946. I am a native and
lived in Fort Collins until 1965, so I am also interested in Fort Collins, as well as, my own well
being.
Attached to this letter is a corrected copy of the letter mailed to Steve Olt, City Planner, previous
to the hearing of the Planning and Zoning Board, May 23, 1994.

Re: Property at 1401 W. Horsetooth Road, adjacent to and east of the Stockbridge Development
Dear Mr. Phillips
As owner of the property at 1401 W. Horsetooth Road, I have many concerns involving the
encroachment of my property.
I am protesting a bicycle path being situated on my property in my horse pasture. This bicycle
path is not viable, considering, it would cut my pasture in two parts and is proposed to be placed
across the widest part of the pasture. As long as my property is rental property, the path would
be a hardship for me, since the rent would be reduced drastically. If this bicycle path was situated
across the middle of the pasture and not enclosed, it would be dangerous for people utilizing the
path. Whether the path is fenced or not, it would be hazardous for the horses. If this path is
installed, the present tenant would have difficulty irrigating this pasture. South of this said bicycle
path, a large proportion of the horse pasture will be without drinking water for the horses.
In no way, do I wish to have a public bicycle path allowing people the legal right to trespass back
and forth across my property. Therefore, I am protesting the passage of the proposed
aforementioned bicycle path to be placed across or anywhere on my horse pasture or property
now or later as long as I own it. When this property is sold and developed, that will be the time
to consider this proposal as to if or where it may be placed, as well as, the bridge over the ditch
for this particular bicycle path.
I was told by Steve Olt, the above bicycle path "probably" would not be built as long as I own the
property. "Probably" does not tell me anything.
I was unaware of the above and following proposals until I attended the Hearing of the Planning
and Zoning Board of the City of Fort Collins for the Stockbridge Development on May 23, 1994
These proposals should have been presented previously at the only Neighborhood Information
meeting on March 10, 1994, or another meeting called for this purpose, or I should have been
notified and informed previously to the hearing March 23, 1994. Consequently, I had no time to
adequately prepare the presentation of my case to the Hearing of the City Planning & Zoning
Board.
Other proposals:
1. Bicycle path to be situated along the west side of ditch, which is also on my property.
2. Street across the middle of my horse pasture. This was not passed due to the protests
of Skyline Acres.

Dear Lois,
I'm writing in response to your letter to Mr. Ron Phillips, Director of Planning for the City of
Ft. Collins, regarding your concerns. Your main concern is over a bike path that was proposed
to cross your horse pasture property. It is my belief that the city would certainly need to
negotiate any bike path that would cross your property. The bike path is only mentioned in the
event your property develops in the future. Should your property develop in the future the
availability to access thru our property is being planned for now.
The reason this item was not discussed at the neighborhood meeting is because we did not know
of it. The request from the city was for a road access across the irrigation ditch which we
negotiated with the Planning Commission to be only a future bike/ped path.
We have also discussed with you a future need for drainage easement thru your property and the
possibility of working together to assist the city in creating a right-of-way for a future bike/ped
path parallel to the irrigation ditch. As we continue to do the engineering on our property we
will be in contact with you.
