meeting was held on July 17 with some of the Golden Meadows HOA Board. The project was
discussed in their formal Board meeting July 18 and they were supportive of the project and felt
there was no need to meet further with the neighborhood group. We request a reconsideration of
the suggested mailing radius based upon this response from the immediate neighborhood.
e. Advisory comment
f. The landscape design meets Section 3.2.1(E)(4)(b) of the Land Use Code. 75% evergreen shrubs,
which provide year round screening around the perimeter of the fuel/parking area are proposed.
g. The kiosk design has been modified per your request.
h. Light will not be reflected off the canopy ceiling since the light fixtures specified for the canopy
will be recessed fixtures, with flat lens, mounted flush with the canopy ceiling. This insures that
there will be no light source dropped below the canopy deck surface to reflect.
i. A photometric light plan is included in the submittal. All site lighting will match existing center
lights and are down directional cut-off fixtures as detailed in the plan.
j. Advisory comment — no signage is proposed for the dispensers.
k. The canopy signage will comply with the Neighborhood Sign District restrictions and will not
exceed 12 square feet.
We trust all of the comments and concerns from the Conceptual Review meeting have been satisfactorily
addressed.

6. Fire Department:
The Fire Department was contacted to discuss their submittal requirements. The applicant intends to
comply with all review and permitting requirements.
7. Light and Power:
a. Development charges have been paid.
b. The transformers are located within 10 feet of a paved surface as required.
c. Advisory comments — no action required at this time.
d. A Commercial C-1 form will be completed and submitted with the construction plan submittal.
8. Transportation:
a. An amendment to the Traffic Study for the center is included in this submittal. The amended
study incorporates alternate mode transportation analysis.
b. The Access Control Plan for Harmony Road was discussed further with Kathleen Reavis
subsequent to the Conceptual Review Conference. She confirmed that the existing access to the
Harmony -Safeway Marketplace Center will be unaffected by the Access Control Plan for
Harmony Road.
c. Several discussions were held with Gaylene Rossiter regarding the bus stop location. Please see
response comments under item 3.c above for more details.
d. Bicycle parking will be provided in Phase I and is located near the westerly drive into the site.
9. Traffic Operations:
a. A Traffic Study Amendment is provided by Krager & Associates and included in the submittal.
b. The traffic study includes the multi -modal section required.

10. Current Planning:

c. Please refer to the attached project justification, which demonstrates project compliance with
Section 3 (General Development Standards) and Section 4.21, HC Zoning District, within which
this project falls. This project is not within the LMN Zone District, as referenced in the
Conceptual Review Conference planning notes.
d. Two sets of mailing labels are provided for all properties identified within the notification area
map that was provided by staff. The cost of postage and mailing preparation was included in the
submittal fee. We question staff's reasoning in expanding the code -required notification area from
500 feet from the property lines of the parcel of land for which the development is planned (Code),
to a notification area of 1,500 feet. We feel this area is not a practical or rational boundary for the
nature of this submittal and has imposed an unnecessary burden on the applicant without
justification. Staff suggested that the notification area was extended to this distance due to this
being a potentially controversial use at this location. We have not found that to be true. A

c. Advisory comment. A note for the contractor has been added on the Utility Plans and the Grading
Plan stating, "Pothole existing water transmission line prior to construction of storm pipe from
outlet structure to grass swale. Report any conflicts to engineer."
d. A manual shut-off on the outlet structure will be provided in case of fuel spills. A note appears on
the utility plan. We meet all Poudre Valley and State Oil requirements for a fueling facility.
e. The drainage and erosion control reports and plans are provided and were prepared by a
professional engineer registered in the State of Colorado.
3. Engineering Department:
a. Advisory comment regarding Street Oversizing Fees — no action required at this time.
b. A utility plan is provided pursuant to your request.
c. Per conversations with the Harmony -Safeway Marketplace P.U.D. designers, the bus stop
discussion was settled with the previous reviews and approvals of the preliminary and final PUD
for the center. The bus stop was designed to the west of the Harmony access and labeled on all of
the above plans. According to the design consultants, the bus pad was located at this location to
connect to the direct pedestrian access route established from E. Harmony Road directly north into
the main in -line retail businesses. Please refer to the approved PUD for reference to this facility.
The facility was located to accommodate the topography of the drainage swale and allow for the
direct connection to the center.
d. Advisory comment — no action required.
4. Water & Wastewater Utility:
a. Services will be provided from the existing water and sewer mains located in the drive at the
northeast corner of the site.
b. We will utilize the existing utility stubs on the site.
c. Advisory comments regarding the 36" water transmission line in the 80-foot Harmony Corridor
setback — no action required.
d. No signs, light poles or structures are proposed within 15' of the 36" water transmission line.
e. Water conservation standards for landscape and irrigation will be observed.
5. Natural Resources:
a. There is no evidence of prairie dogs on the site at this time.
b. The trash enclosure will accommodate recycling containers of sufficient size to accommodate the
type of recycling appropriate for the building use. The dumpster will be enclosed within a
structure constructed of matching materials and color as the buildings. The enclosure will include
an opaque gate.
c. Plant materials have been selected from the palette used for the overall center to continue the
established theme.
d. Advisory comment — no action required at this time.
e. Poudre Fire Authority has been contacted regarding the comment to file a Hazardous Material
Management Plan. All Fire Department requirements will be met.

Response to May 22, 2000 Conceptual Review Comments
Dear Mr. Shepard:
Please accept formal application for a Project Development Plan for the Safeway Fuel Facility at the
above location. The revised plans have incorporated comments provided by city staff at the May 22
Conceptual Review meeting. Following is an itemized response corresponding to the Conceptual Review
Staff Comment letter provided by Troy Jones dated May 30, 2000:
1. Zoning Department:
a. Advisory comment — no action required
b. Advisory comment — no action required
c. Parking will be limited to 4 spaces per 1000 square feet of gross leasable floor area. The proposed
convenience store is 2790 square feet and will be constructed in Phase IL Using this calculation,
the maximum parking allowed will be 11 parking spaces. 8 regular parking spaces are provided
plus one handicap accessible space. The site will be paved with Phase I construction, however the
parking spaces will not be striped until Phase II construction of the convenience store.
d. Bicycle parking is provided near the westerly curb cut and will be installed in Phase I
construction.
e. A meeting was held with Peter Barnes on May 22, following the Conceptual Review Meeting.
We are proposing signage in compliance with Section 3.8 (E), "Non -Residential Uses in the
Residential Neighborhood Sign District." Please refer to the attached project justification for a
detailed description of the signage proposal.
2. Stormwater Utility Department:
a. Advisory comment on Fox Meadows basin stormwater fees required at permit.
b. Although the site was master planned under the old drainage standards, the proposed drainage
report has been designed per the 40 hour extended detention based upon the new rainfall criteria.
