The Wireless Telecommunications equipment has been designed to blend into
the context. Antennae cabinets will be of the same color as the clock tower so as
to be as concealed as possible. The clock tower itself will be constructed of
materials and color that match the building. The equipment will be mounted in a
configuration as flush to the wall as technically possible.
The Project Development Plan complies with all applicable requirements of
Article 3. No evidence was presented to contradict the statements and
conclusion of the staff report concerning compliance or to other refute the
compliance with Article 3.
SUMMARY OF CONCLUSIONS
A. The Harmony Safeway Marketplace, Lot 8 Wireless Telecommunications
Equipment, Project Development Plan, is subject to administrative review and the
requirements of the Land Use Code (LUC).
B. The Harmony Safeway Marketplace, Lot 8 Wireless Telecommunications
Equipment, Project Development Plan satisfies the development standards of the
Harmony Corridor zoning district.
C. The Harmony Safeway Marketplace, Lot 8 Wireless Telecommunications
Equipment, Project Development Plan complies with all applicable General
Development Standards contained in Article 3 of the Land Use Code.
DECISION
The Harmony Safeway Marketplace, Lot 8 Wireless Telecommunications Equipment,
Project Development Plan #33-94H, is hereby approved by the Hearing Officer without
condition.
Dated this 5th day of April 2004, per authority granted by Sections
1.4.9(E) and 2.1 of the Land Use Code.

FACTS AND FINDINGS
The surrounding zoning and land uses are as follows:
N: M-M-N; Existing Patio Homes (The Enclave)
S: H-C; Existing Neighborhood Shopping Center (Village Inn)
E: H-C; Existing Neighborhood Shopping Center (Safeway)
W: M-M-N; Existing Condos (Rock Bridge Condos)
The Golden Meadows area was annexed in 1977 as part of a 234-acre parcel
known as the Harmony Annexation. The shopping center was originally platted
as Tract B, Golden Meadows, 5th Filing, approved in 1980.
Lot Eight of Harmony Safeway shopping center was approved in May of 2003.
This building is presently under construction. A minor amendment will be
submitted to add the clock tower to the approved architectural elevations.
Two informative and productive neighborhood meetings were conducted.
Through this collaborative effort, consensus was achieved. The result is the
clock tower design as proposed with this application.
1. Compliance with Article 4 and the HC Zoning District Standards:
The Project Development Plan complies with all applicable requirements of
Article 4 and the HC Zoning District. The Staff Report summarizes the PDP's
compliance with these specific standards and no specific evidence was
presented to contradict the statements and conclusion of the staff report
concerning compliance with Article 4 or the HC District Standards.
2. Compliance with Article 3 of the Land Use Code — General Development
Standards
The proposed clock tower represents an acceptable form of stealth technology
as described in Section 3.8 (C)(15). The clock tower is a "mimic" structure that is
often found in shopping centers as an architectural accent. The clock tower will
be in context with the neighborhood shopping center.

NOTICE OF PUBLIC HEARING: Evidence presented to the Hearing Officer established
no controversy or facts to refute that the hearing was
properly posted, legal notices mailed and notice
published.
PUBLIC HEARING
The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the
hearing at approximately 4:30 p.m. on April 1, 2004 in Conference Room A at 281 North
College Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE:
The Hearing Officer accepted during the hearing the following evidence: (1) Planning
Department Staff Report; (2) application, plans, maps and other supporting documents
submitted by the applicant and the applicant's representatives to the City of Fort Collins;
and (3) a tape recording of discussion provided during the hearing. The LUC, the City's
Comprehensive Plan (City Plan), and the formally promulgated policies of the City are
all considered part of the evidence considered by the Hearing Officer.

This is a request to incorporate a wireless telecommunication antenna into a new clock
tower installation at 1414 East Harmony Road. The tower would be located at the
southeast corner of the multi -tenant retail building presently under construction. The
clock tower would be square -shaped with the dimensions being ten feet by ten feet. The
total height would be 42 feet, from grade to the top of the pitched roof.
