WHEREAS, on January 18, 2001, the City Planning and Zoning Board (the "Board") conditionally approved the Harmony Safeway Marketplace Lot 6, Safeway Fuel Facility P.D.P #33- 94F, with the condition that there be not flush wall signs on the south and west elevations of the proposed convenience store building; and WHEREAS, on February 2, 2001, a Notice of Appeal of the Board's decision was filed with the City Clerk by Galloway, Romero & Associates as representatives of Safeway Stores 46, Inc. ("the Appellants"); and WHEREAS, on March 20, 2001, the City Council, after notice given in accordance with Chapter 2, Article II, Division 3, of the City Code, considered said appeal, reviewed the record on appeal, heard presentations from the Appellants and other parties in interest and, after discussion, decided to modify the decision of the Planning and Zoning Board by eliminating the condition imposed by the Board regarding the flush wall signs on the south and west elevations of the proposed convenience store building.' NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that, pursuant to City Code Section 2-56(e), the Council hereby makes the following findings of fact and conclusions: 1. That the grounds for appeal as stated in the Appellant's Notice of Appeal conform to the requirements of Section 2-48 of the City Code. 2. That the Board failed to properly interpret and apply the relevant provisions of the City Code and Charter, specifically the provisions of the City's Land Use Code pertaining to signage as set forth in Section 3.8.7(E)(2) and also Section 3.5.3(D)(1) in requiring the removal of flush wall signs on the south and west elevations of the proposed convenience store building. 3. That the City Council upholds the decision of the Board in approving the Harmony Safeway Marketplace Lot 6, Safeway Fuel Facility P.D.P., but modifies that decision of approval by eliminating the condition imposed by the Board that required the removal of the flush wall signs on the south and west elevations of the proposed convenience store building. PLAN Sections: 2.5.1 Purpose and Applicability 2.5.2 Final Plan Review Procedures Purpose and Applicability Section 2.5.1 The purpose and applicability of a final plan is contained in Section 2.1.3(D). Final Plan Review Procedures A final plan may only be submitted after approval of a project development plan for the subject property or concurrently with a project development flan for the subject property. For consolidated applications for a project development plan and a final plan, the applicant shall follow both the project development plan and final development plan review procedures. A final plan shall be processed according to, in compliance with and subject to the pfovisions contained in Division 2.1 and Steps 1 through 12 of the Common Development Review Procedures (Sections 2.2.1 through 2.2.12, inclusive) as follows: (A) Step 1 (Conceptual Review): Not applicable. (B) Step 2 (Neighborhood Meeting): Not applicable. (C) Step 3 (Development Application Submittal): All items or documents required for final plans as described in the development application submittal master list shall be submitted. The Director may waive or modify the foregoing submittal requirements if, given the facts and circumstances of the specific application, a particular requirement would either be irrelevant, immaterial, redundant or otherwise unnecessary for the full and complete review of the application. We have already completed the Final Plan review. When we first met in May of 2000, we were told by you to satisfy both the Project Development Plan and Final Plan submittal requirements and checklists, which we did. All of the requirements for both checklists were submitted and reviewed over the past year's process. The plan has always been labeled "Final Plan Approval" for that reason. The Fort Collins Land Use Code provides for a concurrent project development plan and final plan review if the applicant follows both of the review procedures (LUC Section 2.5.2). That was why all of the material was provided with the August 1, 2000 submittal. Our understanding is the only items that I owe you are Final Plan mylars and the reduced PMT's. Civil engineering mylars were requested and submitted February 26. Full permit sets were submitted to Building Department on March 14 and should be nearing completion of review. One of the reasons we went through concurrent review to obtain "Final Plan Approval" was to be able to proceed with the building permit as soon as the hearing process was completed. As you know, this Final Plan was not only reviewed and approved by Planning Development Review Staff, but also through public hearings at Planning Commission and City Council. Our files contain two staff reports containing over two hundred pages of review and analysis. Included in these packets is the staff's statement of project compliance to the Harmony Corridor Zone District and Neighborhood Service Center planning area, Harmony Corridor Standards and Guidelines, City of Fort Collins Land Use Code General Development Standards and the approved Harmony Safeway Marketplace Final PUD. Another review of these approved Final Plans is unwarranted, inconsistent with the review of the last year, and redundant. Please confirm that we can submit mylars to complete this process.
