The signed mylars are enclosed for City approval signatures. Engineering received the
final stamped civil engineering sets and executed Development Agreement on 5/25/01.
A check for the Street Oversizing Fee will be delivered to the City on 5/30/01. We
request that Planning sign off on the building permit so that construction might begin by
June 1.

Thank you for your May 15 letter outlining final staff requests. The enclosed mylars
reflect the response to the items outlined in your letter as follows:
1. Thank you for the suggestion for the sidewalk/boulder/landscaping modification,
however we will not incorporate it into the site design. Current Planning Staff
specifically requested the current sidewalk configuration and additional landscape
area at our September 15, 2000 meeting. This was again outlined in the November
15, 2000 staff comments specifically asking for elimination of the northern most
parking space and an additional Spring Snow Crab ornamental tree. We
accommodated staff's requests at that time and staff stated we met all of the
development design standards in the final staff reports. We will remain with that
design.
2. General Note 8 on Sheet One of Six has been modified to reflect a construction
date of 2001.
3. Plant Note Six on Sheet Three of Six will remain on the plan. This note has
appeared on all previous plans approved in the City.
4. As you know, signage is a sensitive issue with Safeway and was the subject of the
City Council appeal. Since this was a part of the document read into the record of
both Planning Commission and City Council, Safeway and their attorneys advise
that it remain on the plan with the note stating that separate permitting is required to
obtain a sign permit.
5. Thank you for the suggestion to extend the shrub bed to the sidewalk edge. This
was our oversight and would have been corrected during construction. The plan is
amended to reflect the change.
