RE: Platinum Auto Brokers - Reconsideration of Final P.U.D.
On August 30, 1994, at the continued meeting of the Planning and
Zoning Board, the Board voted to bring up for reconsideration the
Conditional Final Approval originally granted on August 22, 1994.
The Board then voted to continue the reconsideration of the
decision to the next regularly scheduled meeting of September 26,
1994.
During Board discussion, the stated purpose of the reconsideration
was to attach a condition to the Final P.U.D. that limits the
applicability or the transferability of the P.U.D. if there is a
period of discontinuance of usage of auto sales and service on the
property.
In subsequent discussions with the City Attorneys Office, an
individual board member raised the issue of establishing a
reasonable time frame after which Platinum Auto Brokers would be
required to install the improvements called for in the Design
Standards/Requirements section of the North College Avenue Corridor
Plan.
After discussing this issue with the applicant, Staff recommends
that the following language be added to the P.U.D.:
The approval of this P.U.D. Plan is based, in part, upon the
applicant's promise to comply with the North College Avenue
Corridor Plan "Design Standards/Requirements" if enacted by the
City, provided, however, that the applicant shall be allowed a
period of twelve (12) months after such enactment to bring the
P.U.D. into such compliance. If compliance is not achieved, in the
judgement of the City Zoning Administrator, within said twelve
month period, then this P.U.D. will expire and terminate,
notwithstanding any "vested right" that may otherwise have existed
because of the approval of this plan.
Staff believes this restriction and commitment for future
improvements, based on the North College Corridor Plan, meets the
