possibility that future street widening and other road
improvements may be implemented on North College making a
permanent closure at this time premature.
13. Please be aware that the Planning Department is presently
working on the North College Avenue Corridor Plan. The
project planner is Janet Meisel, 221-6750. The plan is
designed to review City zoning policies, and other design
considerations on North College Avenue from the Poudre River
to the "Y". The target date for plan completion is the middle
of 1994. You and the property owner are encouraged to get
involved in this planning process so your concerns and
comments can be heard.

5.. The Poudre Fire Authority requires that display vehicles, or
vehicles under repair, not block, fire access to the building.
Access - for fire equipment around the building must be
preserved or the owner will be in violation of the Fire Code.
If there are expansion plans for the building, then the access
and water supply requirements of the Fire Code, must be
maintained.
6. For your information, the property is a platted lot known as
the Hall's First Addition Subdivision.
7. If there are to be any building expansions or any expansion of
the hard surface area, then onsite detention of storm flows
will be required. If onsite detention is triggered by any
future improvements, then offsite drainage easements must be
obtained to convey the storm flows to Dry Creek.
S. The property is in the floodplain of Dry Creek. As such, any
building expansion would require a Floodplain Use.Permit from
the Storm Drainage Board. If you have any questions regarding
drainage issues,,please contact Glen Schlueter, 221-6589.
9. The City's Transportation Department will require information
on how the is operating in terms of traffic generation. An
estimate on the number of cars serviced by the mechanic and an
estimate of the number of customers visiting the car lot must
be provided. These estimates should be made based on a
typical busy day during the week, plus the Saturday operation.
Information provided to the Transportation Department should
be emphasize that, with the underground gas tanks removed,
there are no retail gas customers as there once was when the
site was a Texaco service station. Please contact Rita Davis,
Transportation Department, 221-6608, if you have any questions
on providing traffic information.
10. Since College Avenue is State Highway 287, the State
Department of Transportation must review the request. The
applicant, or the applicant's consulting engineer, must
complete the State Highway Access. Permit application
procedure. This application is made via the City's
Engineering Department. Please contact Kerrie Ashbeck, 221-
6750, for details.
11. The City's Engineering Department will work with the State of
Colorado on reviewing the access situation onto North College
Avenue. Both the City and the State are reviewing access all
along the highway and are preparing. a North College Avenue
Access Control Plan. Please be aware that there may be a
possibility that present curb cuts may be consolidated with
other properties or closed.
12. If .the State requires curb cut closure, the City's Engineering
Department will work with the owner on constructing a

CONCEPTUAL REVIEW STAFF COMMENTS
MEETING. DATE: September 27, 1993
ITEM: 1845 North College Avenue - Auto Sales
APPLICANT: Mr. Gary Farkas, P.O. Box 1323, Loveland, CO. 80537
LAND USE DATA: Request to allow auto sales in the H-B zone at 1845
North College Avenue as a joint use with automotive
repair.
COMMENTS:
1. The property is located in the H-B, Highway Business Zone
District. Since 1977, this zone does not allow auto sales as.
a "use by right". Unless it can be demonstrated. that auto
sales have been a continuous use on the property since prior
to enactment of the zoning of the property (1977), the request
for auto sales on this property must be processed as a Planned
Unit Development for consideration by the Planning and Zoning
Board.
2. The inclusion of an additional 'use on the property will
trigger improvements to the landscaping. The Zoning Code
requires that there be a 15 foot landscape setback along
College Avenue, and 5 foot landscape setback around other
perimeter property lines to screen the parking lot and parking
lot drive aisles. Also, the Zoning Code requires that 6% of
the interior parking lot area be landscaped in the form of
islands.
3. _Please be aware that these are Zoning Code requirements and
would be triggered merely by the change of use on the
property, even if the new use is allowed by right in the H-B,
Highway Business Zone. As •a Planned Unit Development
(P.U.D.), the Planning Department and the property owner can
work together on a flexible basis to implement these Zoning
Code requirements in a reasonable manner. For example, on
this particular site, it may make more sense to concentrate
the landscaping on the perimeter and take a flexible approach
to the 6% interior requirement.
4. The Building Inspection Division will need verification that
the wall that separates the office from the mechanic bays is
property rated for fire containment. Please contact Mike
