Collins, CO 80522 Re: Waterfield Third Filing July 5, 2018 Dear Mr. Shepard, The Waterfield Third Filing Plat was recorded Aug. 7, 2014 and is due to expire. The property is now under contract and purchaser is in process of preparing a submittal to request a re -plat. However, this process will not be completed prior to the expiration of our plat extension granted last year. Therefore, we will need, and respectfully request a one (1) year extension to Aug. 7, 2019 for the Waterfield Third Filing Plat and all associated documents. As stated in your request, Waterfield Third Filing was recorded on August 7, 2014. Normally, the three-year term of vested property right would have expired on August 7, 2017 but you requested, and the City granted, a one-year extension to August 7, 2018. The second request, like the first, is governed by Section 2.2.11(D)(4) of the Land Use Code. Again, Staff finds that the request for a one-year administrative extension has been timely filed. In addition, Staff again finds that Waterfield Third Filing continues to comply with the general development standards as contained in Article Three and the zone district standards as contained in Article Four. Staff further finds that Parker Land Investments, LLC has been diligent in complying with the criteria for securing a vested property right but that due to other extraordinary and exceptional situations unique to the property, completing all engineering improvements would result in unusual and exceptional practical difficulties or undue hardship upon Parker Land Investments, LLC. Finally, Staff finds that the granting of a one-year extension would not be detrimental to the public good. Based on these findings, Staff hereby grants the one-year administrative extension resulting in a new expiration date of August 7, 2019.
