Section 3. That the following provisions shall be established as a
mandatory locational/land use standards in the Harmony Corridor:
All retail and commercial development shall be located in shopping
centers.
All community regional shopping centers shall be located at the
intersection of two arterial streets.
Section 4. That Section 29-526(D)(2), Activity "C," Community Regional
Shopping Center, Criteria (3)(b), of the Code of the City be amended to read as
follows:
3.(b) Is the project contiguous to a"' ee}e fer arterial
street?

ORDINANCE NO. 96, 1994
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING SECTION 29-526(D)(2)
ACTIVITY "C" AND SECTION 29-526(E)(5)
OF THE CITY CODE; AND AMENDING THE HARMONY
CORRIDOR PLAN, IN REGARDS TO THE LOCATION
OF CERTAIN RETAIL ACTIVITIES
WHEREAS, by Resolution 91-42, the City Council has previously adopted a
Harmony Corridor Plan (the "Plan") to guide the future development of the Harmony
Corridor; and
WHEREAS, the Council has determined that the Land Use Policies LU-4 and LU-
5 of the Plan should be amended to clarify the intent of the Plan regarding the
development of retail and commercial land uses in the Harmony Corridor; and
WHEREAS, the Council has further determined that "community regional
shopping centers," as that term is defined in the Land Development Guidance
System ("LDGS"), should be located in the Harmony Corridor only at the
intersection of two arterial streets;
WHEREAS, Section 29-526(D)(2) of the LDGS, pertaining to Activity "C,"
awards points for proposed community regional shopping centers that are located
contiguous to "collector and/or arterial" streets; and

WHEREAS, the Council has determined that, in order to be consistent with
the Plan, points for community regional shopping centers should, under Activity
"C"(3)(b) of the LDGS, only be awarded for projects that are contiguous to
arterial streets; and
WHEREAS, the Council has further determined that Section 29-526(E)(5) of
the Code of the City should be amended to allow for the establishment by the City
of "locational and land use" standards, guidelines and policies for the purpose
of implementing and interpreting the provisions of the LDGS; and
WHEREAS, the Council has also further determined that land use policies LU-
4 and LU-5 should be established by the City as such locational and/or land use
standards to be used in implementing the Plan through the LDGS.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That Land Use Policies LU-4 and LU-5 of the Harmony Corridor
Plan shall be amended to read as follows:'

Attached is a copy of the most recent draft of the Ordinance. The
Planning and Zoning Board and City staff urge you to attend the
June 6 meeting and express your views on the proposed amendments.

to consider the matter during their June 7 meeting.

On Monday, June 6, 1994, at approximately 6:30 p.m. in the Council
Chambers, 300 LaPorte Avenue*, the Planning and Zoning Board of the
City of Fort Collins will be considering certain changes to the
Harmony Corridor Plan and Land Development Guidance System (LDGS).
On May 23, 1994, the Planning and Zoning Board considered a similar
set of amendments and recommended that they be tabled for a sixty
day period during which additional citizen input would be received.
Since May 23, the staff has prepared a revised Ordinance based on
the comments received at the Planning and Zoning Board hearing. The
subject of the meeting on June 6 will be the following amendments
to the Plan and LDGS:
1. Clarify policy LU-5 of the Harmony Corridor Plan that
future community/regional shopping centers along Harmony Road
should be located at the intersection of two arterial streets.
In the Harmony..Road corridor, arterial street intersections
include College Avenue, J.F.K. Parkway (extended), Lemay
Avenue, Timberline Road and County Road 9.
2. Clarify the right of the City to establish locational and
land use standards for the purposes of implementing and
interpreting the provisions of the LDGS;
3. Establish policies LU-4 ("retail and commercial uses
development shall be located in shopping centers") and LU=5
(community/regional shopping centers should be at arterial
street intersections) as mandatory locational standards in the
Harmony Corridor; and
4. Eliminate an' inconsistency in the LDGS with LU-5 as
amended.
