Bill Tiley, requested an administrative six month extension. The extension was granted to extend validity to May 18, 1982. No additional extensions were requested. This Preliminary P.U.D., therefore is considered expired. 5. December 22, 1980, "Golden Meadows Fifth Filing, Final Subdivision." (This is the final subdivision plat that legally carves out the B-P site and is referred on the plat as "Tract B, Golden Meadows, Fifth Filing. This is the same legal description as being used by King Soopers. This is a valid, legal lot. King Soopers, therefore, does not have to plat the property.) 6. June 27, 1984, "Golden Meadows Fifth Filing Master Plan" (This is the current, valid Master Plan, now referred to as Overall Development Plan, for the King Soopers site. The subject site is designated as Parcel 4 and called out to be "Neighborhood Center." Therefore, an amended O.D.P. is not necessary for King Soopers.) 7. June 27, 1984, "Golden Meadows 5th Filing, Neighborhood Center P.U.D., Preliminary." (This is basically a resubmittal of the September 22, 1980 Preliminary P.U.D. which expired on May 18, 1982. The P.U.D. remains a neighborhood shopping center anchored by supermarket. Total square footage illustrated is 177,475 square feet.) (This P.U.D. is considered expired. In 1984, Preliminary P.U.D..'s were considered valid for only one year versus the three year time period in place today. Time validity could be extended administratively by Staff for two, six month extensions. Extensions were not requested nor granted for this Preliminary P.U.D. Therefore, the expiration date would be June 27, 1985.) In Summary: Master Plan/O.D.P.: Golden Meadows Fifth Filing - current. Plat: Golden Meadows, Fifth Filing - current. P.U.D.: Golden Meadows Fifth Filing Preliminary - expired. Please note: current B-P zone allows development as "use by right" since there is no condition on the zoned property .requiring a P.U.D. Current proposal: Neighborhood Shopping Center, 154,342 total square feet, anchored by a 66,692 square foot grocery store. Zoned T, Transition, 18.3 acres. (Harmony Annexation Ordinance No. 97-1977) 2. March of 1979, Rezoned from T, Transition, to B-P, Planned Business. (Ordinance No. 22-1979) , 3. October of 1980, the zoned areas are geographically adjusted by moving the boundary of the R-P zone north about eight feet to align with the Warren Trunk Sewer Line and the southern boundary of the Golden Meadows Fourth Filing. (Ordinance No. 145-1980) (Note: Ordinance No. 145-1980 does not include the condition that the B-P zone develop as a P.U.D.) The Agenda Item Summary refers to removing a restriction, by agreement, of limiting the commercial and office development to 100,000 square feet of gross leasable area. In action related to Ordinance 145-1980, the A.I.S. states: "The 100,000 square feet gross leasable area limitation to the B-P site would be removed." Please note that I cannot find in the files where this "agreement" to limit gross leaseable area to 100,000 square feet was documented. Also the A.I.S. states: "In March, 1979, the 18.3 acre T zone was placed in the B-P Zoning District to allow for a mixed commercial and office development." 4. September 22, 1980, Preliminary P.U.D. for "Golden Meadows 5th Filing, Neighborhood Center P.U.D." (This is the first of two Preliminary P.U.D.Is on the 18.3 acre B-P site and includes the R-P site north of Monte Carlo Drive. As approved by P & Z, it consisted of 150,000 square feet of commercial uses for a neighborhood shopping center, and 124 multi- family units north of Monte Carlo, on a total of 32.5 acres.)
