Dear Resident:
On July 5, 1994, the City Council adopted Ordinance No. 103,
1994, which placed a temporary suspension on the processing of
most commercial and retail development applications within the
Harmony Corridor until January 15, 1995.
Next Tuesday, October 18, 1994, at 6:30 p.m., in the City Council
Chambers, 300 Laporte Avenue, the Fort Collins City Council will
consider an amendment to Ordinance No. 103. At present, the
ordinance exempts only those PUD plans and site reviews that
received preliminary or final approval before the date of passage
of the ordinance. The proposed amendment would also exempt those
developments that had filed applications for approval prior to
that date.
The effect of this change would be to (1) exempt two PUD
proposals from the moratorium, including King Soopers at Golden
Meadows, and (2) allow those applications to be processed under
the City's existing land use ordinances, regulations and
policies.
As you may know, the Golden Meadows commercial center is located
on the north side of Harmony Road, between Wheaton Drive on the
west and McMurry Drive on the east.
The amendment is being proposed in response to recent
developments in Colorado case law and in settlement of litigation
filed against the City by the developer of King Soopers at Golden
Meadows.
