MINOR SUBDIVISION PLAT ADMINISTRATIVE REVIEW HEARING PARK SOUTH COMMERCIAL PLAZA MINOR SUBDIVISION, SECOND FILING PLANNING DEPARTMENT PROJECT #37-94A WHEREAS, the applicant, Park South Limited, a Colorado Limited Partnership, has duly followed the City procedure for a Minor Subdivision as outlined in Section 29-644 of the City Code and has submitted an application for a Minor Subdivision Plat of the following described property, to wit: Situate in the Northeast 1/4 of Section 35, Township 7 North, Range 69 West of the 6th Principal Meridian, City of Fort Collins, County of Larimer, State of Colorado; more particularly described as a Replat of Lots 2 and 3, Park South Commercial Plaza Minor Subdivision; and WHEREAS, the City Planning Department processed the application request in accordance with Section 29-644 including publication of legal notification in the local newspaper with daily, general circulation and giving written notice to the owners of record of all real property within five -hundred (500) feet of the property lines of the parcels of land for which the Minor Subdivision Plat was submitted; and WHEREAS, the Director of Planning, or his duly authorized representative, held a public hearing on Thursday, November 14, 1996, at 2:00 p.m., in the Current Planning Department, 281 N. College Avenue, Fort Collins, Colorado for the purpose of reviewing the Minor Subdivision application and for the purpose of establishing a vested right under Article 68 of Title 24, C.R.S. NOW, THEREFORE, IT IS HEREBY DETERMINED BY THE DIRECTOR OF PLANNING OF THE CITY OF FORT COLLINS THAT: The Minor Subdivision Plat, known as Park South Commercial Plaza Minor Subdivision, Second Filing, is approved with no conditions. As grounds, therefore, the following facts are found to be true: A. The proposed Plat qualifies as a Minor Subdivision as defined in Section 29-644(a) of the City Code. B. The proposed Plat meets all requirements of Section 29-644 of the City Code. C. Each of the 6 lots have frontage on a public right-of-way (W. Horsetooth Road and/or Manhattan Avenue). D. The proposed Plat is not detrimental to the public health, safety, or welfare.
