Hearing Testimony, Written Comments and Other Evidence
Chief Planner Shepard said his understanding is it's the Board's intent to continue the item to the
January 19, 2012 Planning & Zoning Board Hearing. Chair Stockover indicated the topic was covered at
their December 2, 2011 worksession. The Board will continue their review at their January 13
worksession.

Member Schmidt made a motion to move the Planned Development Overlay District to the
January 19, 2012 Planning & Zoning Board Hearing. Member Hatfield seconded the motion. The
motion was approved 6:0.
Project: One Year Extension of Lind Property, Second Filing, # 39-94E
Project Description: The property is located east of Turnberry Road and north of Richards Lake Road.
The Final Plan was approved in 2007 and was granted a vested right for three
years. In addition, two one-year administrative extensions were granted vesting
the project to January of 2012. The project consists of 153 dwelling units on 44.38
acres. The property is zoned L-M-N, Low Density Mixed -Use Neighborhood.
Recommendation: Staff recommends denial

Chief Planner Ted Shepard said this is a request to extend the time validity for the Lind Property 2"d
Filing for one year. They've already had two administrative extensions. They must come to the Planning
& Zoning Board for a continued extension. His understanding after the Board's consideration at the
December 2, 2011 worksession; it is the preference to continue to January 19, 2012.

Member Schmidt made a motion to continue the Lind Property Second Filing Final Plan #39-94E
to the January 19, 2012 Planning & Zoning Board Hearing. Member Carpenter seconded the
motion. The motion was approved 6:0.

Member Carpenter made a motion to approve the minutes of the November 3, 2011 Special
Hearing and November 17, 2011 Planning & Board Hearing. Member Hatfield seconded the
motion. Motion was approved 5:0 with Chair Stockover abstaining.

Project: Planned Development Overlay District
Project Description: This is a request for a recommendation to City Council regarding an Ordinance
which would adopt the proposed Planned Development Overlay District (PDOD).
The PDOD includes several new additions and revisions to the Land Use Code in
order to provide a new, optional development process and standards for infill
development and redevelopment. PDOD projects will also assist in achieving the
City's sustainability goals. City Council is scheduled to consider the Ordinance on
December 6, 2011.
Recommendation: Staff recommends approval
