As promised, we discussed internally whether or not the private gas line would be allowed within the public row and/or if we would allow a variance to our standard street section. The result of those discussions are that the city is not favorable to varying the local street section to accommodate a 23' private utility easement (ie: placing the row at the back of curb and placing the front of walk 23' back from there, no street trees). Engineering did not feel that the proposed street section was equal to or better than what the city currently requires and no variance will be granted. Private easements are not allowed in public row but the oil company line could be in the ROW under a Council issued revocable permit (per the City Charter) or probably under a Franchise, or under a city engineer issued encroachment permit if it fits the criteria of the City Code found in Section 23-81. Section 23-81 outlines the entire process and under what conditions that permit is allowed. I do not know if a revocable or encroachment permit would be issued in this case. You are welcome to apply but I can't make any guarantees that you will get it. Let me know if you come up with any ideas though.
