The Anadarko entities would agree to a permanent easement along the west side
of Clarion Lane for pipelines which would consist of an area that is twenty-three feet
wide and that abuts the west side of Clarion Lane; provided, however, the twenty-three
foot easement must be for the exclusive use of oil and gas pipelines, and no permanent or
temporary structures or other improvements may be constructed within or on top of the
easement.

This letter follows up our telephone conversation on July 6, 2004 concerning the
property located in Larimer County described as portions of the NW/4 and the SW/4 of
Section 29, Township 8 North, Range 68 West, which is to be developed by Centex
Homes as the Lind Development and which was the subject of my letter to you dated
April 12.
In our telephone conversation, we discussed the access route and pipeline
easements for the proposed future wellsite location in the NW/4, and you asked me to
find out from the Anadarko entities which access they would like into the wellsite
location and the requirements for the pipeline easement.
1 have discussed your suggestions with representatives from Anadarko UP
Company LP, and they agree that access to the wellsite should be directly &Om the south
along Clarion Lane.

In light of the COGCC rules, 1. suggest as we discussed in our meeting that an
additional "no build zone' of 150 feet from the outer boundary of the wellsite location be
created within the area designated as the community center area.

among those described as Thoreau Road, Clarion Lane and liar Harbor Lane, keeping in
mind the width requirements for the access road and the pipeline easements together, as set
forth in the draft of the surface use agreement that l have provided to you.

Thant: you for providing me with the site plan for the Lind Property Development in
Laritner County to be located on the property referenced above and which is dated April 30,
2003 and shows your proposed wellsite location..
As we discussed, the plat shows a wellsite location which consists of a circle with a
radius of 200 feet as is outlined in the letter agreement dated May 8, 2003. As I mentioned
to you in our meeting a few months ago, the location of the drill site within an area identified
as a community center is a concern to the Anadarko entities.
The Colorado Oil and Gas Conservation Commission ("COGCC") Rules provide in
Rule 603.c. and 603.d. that i) the high -density rule setback of 350 feet applies to -an
educational facility, assembly building, a hospital, nursing home, board and Care facility or
jail" that is located within one thousand feet oi'a wellhead or a production facility; and ii) rile
minimum setback for an area identified by the COGCC as a "designated outside activity
area" is 3 50 feel -

Re: Notice of Severed Mineral Rights
Dear Molly.
The notice mailed by Centex Homes on June 25, 2004 regarding an application to
subdivide land for residential uses is for the Land Property 2nd Filing, Project
Development Plan, File #39.94D. I have attached the notice from the City of Fort Collins
for you records. The next step in the process is the Final Development Plan, Final Plat
and Construction Plans. During the development of these plans we will finalize our
Surface Use Agreement. Please let me know if you have any concerns or questions. I
will make sure our attorney reviews the Surface Use Agreement in the next week and we
move forward to finalize the agreement. Thank you for your time. I will Contact you with
the plans and any comments on the Surface Use Agreement prior to our submittal to the
City of Fort Collins.
The Project Development Plan application was submitted to the City of Fort Collins on
March 23, 2004, a public hearing is scheduled for July 13, 2004 at 5:00 p,m. at 281
North Colle;e Avenue.
