Would you be wining to consider a vommitnaent that the mexlmma rate of discharge
from storm water accumulations that you will ask from the eu*c subdivision into our adshng
ditch facilities will not cxcccd 10 CPS. You will, of course, agme to join in, connect or
participate in any upgraded or revised drainage system developed in accordance by the City's
master plan or by any governmental agency itself, at such time as it is appropriate. That is of
some concern to me but probably of more concern to the City and I'm sure that issue will be
adequately covered in their development agreement. Please confer with your engineers and your
other people and give some consideration as to wbetber or not you can. commit at this time to a
maximum rate inflow from storm water collections from your subdivision at the rate of 10 CPS
cud we will talk further.

The basic thesis of my recent rowed of was that these diiags really need
to be looked at globally. Ivey client can ba a no "legal" objection to your Phase I retention pond
as it dacan't affect our ditch at all. However, looking at this subdivision that you propose as a
whole and wbere we dunk it probably needs to go in tams of dealing with stoma water, the
Phase I is of concern as what's done there may relate to the overall eMct of the other pbases and
ultimately the completed project on the ditch. I had no intention one way or awffier as to the
reaction of the City as that's their business and discharge of their govercunental responsibility.

bigger way.
Our ditch can and will (with appropriate agreements and compensation) take a portion of
your storm viatm We will take what we can handle. My objective is to assist in the most
sensible planning possible, which I believe involves taking a modest amount of water, believing
that this is something that we can live with tatdl the overall master plan is developed and
implemented. At that time I would expect that a larger queutity of water can be handled by the
new and better system. However, I don't really know that so I have to agree to that which we
can live with forever if that's wbat we are 1ef3 with. I believe that the City of Fort Collins does
want to proceed with sensible planning in the area and we would like to be a team mamba in
that regard, so we wM take some of rho storm water into our existing facility to the extent that
our existing facility can physically handle it One of the reasons that we are asking that a
particular development only contribute a fairly modest amount of water to the ditch is that
there's only so much capacity and I see a Hoed to spread that capacity ota over as many
developeas as possibly =1il more capacity is available. Frankly, beyond what it anticipate we are
willing to take Emm your subdivision in its entirety, I am very reluctant to agree to my additional
stony water fhrws.
Even though my attorney -client focus is strictly to the protection of my ciieut's physical
facilities eod their operation for the bcmfrt of the agrivultuual shareholders, I dry have an
expanded interest, having resided in this city for 38 years and having had my prafessifln here £ar
34 of them. To M_tgq all of the storm water runoff from the entire proposed deveiapmnat just
isn't good planning and I would be surprised if that would be approved. Retndon ponds in my
opinion we a poor solution. They can result in deep, stagnant water which not only poses a
darsgm to ndglrborhoods but typically smells bad and grows stuff Reeerrtien ponds are a poor
we of land because it's hard for there to have multiple uses. Because they may well bow water
in them a larva part of the time, it's difficult to develop them into attractive grassy areas with
walking trails and other amenities, which detention facilities may not prevca because the water
isn't going to be there too ion$.
What we would like to have is a commitment from you as to the maximum amount of
storm water runoff that you wail ask to discharge into our wdsting ditch facility from the whole
approximate 175 acre development. I think this understanding can be very productive as it may
of cct bow ron design and approach coon Phase I whom you intend to retain all the water. Our
primary concern is rate and that's the major item that your people need for sizing. We certainly
have water quality concerns, but are not terribly concerned about overall water quantity as long.

the subject matter of your letter of that same date foxed to me.
Let me clear a few things up. I believe The City of Port Collins storm water people are
doing just fine! I am not at all irvsttated with the master -,- - water plan or how it is coming
along. Certainly we have concerns and there are parts of It we ddnlc ate great and parts of that
eoncem us. It is still in the plemd stages and we are working together an tbcsr various issues
from time to tithw. In at pedlect world it would be Smat to h6(ve rho master plan Smnlized and
My implemented on the ground before a shovel of dirt was turned. Howtwer, this is not reality.
So what we are trying to do is involve the ditch company in some compromises that WM allow a
reasonable and modest amotmt of development In the drainage aaTaa that affects out ditch while
akl this comes togetbe . ihus, we are vdffing to take a smau quantity of water into the ditch from
a certain amount of development as hopeiitlly more development and the availability, of the
stoma water runoff system omvaargc.
We enjoy a good working relationship with the storrtt water People in our CITY
gove:mment and we've rwmlwd hard to share a vision. I pardcularly cornTnend Bob. Glen and
Sash in this regard, not to eueiudc others. The City's task is doing good land »c planning and
development wound be a whole lot easier if our ditche9 didn't oast On the outer hand, land use
and development bring little if anything to the innigation companies, so we wound Mice not to bave
to deal with it either. So, consequently we are working togetl= with a high degree of sensitivity
to each other's needs.

Dear Ms. Seaman:
Boxelder Sanitation District has reviewed the construction plans for the development of the Und Property,
Filing I and is aware of the proposed realignment of the 15" sanitary sewer collector line on the property.
The district is in agreement with the proposed realignment upon the following conditions:
Realignment activities of the active sanitary sewer collector line shall be done in accordance with
district standards and specifications. Actual field activities by the developers subcontractors to
accomplish the realignment will be subject to district oversight:
Abandoned segment of original sanitary sewer line will either be removed and the area reclaimed
to district standards and specifications, or if the line is left In place, It shall be filled with concrete.
The remediation of the area of the original alignment I9 the sole responsibility of the Lind Property
development agent(s).
The relocated sanitary sewer line will be aligned within dedicated right-of-way throughout the Und
Property, Filing 1, and the district will vacate the existing sanitary sewer easement with the final plat of the
subdivision. This vacation will be accomplished by a separate document following the acceptance of the
realigned sanitary sewer.
